HomeMy WebLinkAboutResolution No. 344-07 • RESOLUTION ' WHEREAS, the City of Rochester applied for an Incentive Development (#R2007- 022CUP) to permit the construction of the 'Bio Business Center and expand the First Avenue S.W., parking ramp. The properties are located west of First Avenue S.W., and between Second Street and Fourth Street S.W., lying north and south of Third Street S.W.; and, WHEREAS, R.C.O. § 62.630 sets forth the criteria for incentive developments; and, WHEREAS, based upon Section 62.630, the Planning and Zoning Commission recommended the following findings of fact: Preliminary Development Plan Criteria: a) Suitability of the Area: The proposed site is suitable as the location for an Incentive Development. The proposed retail and office uses are compatible with the existing land uses along 1st Avenue and in this portion of the CBD adjacent to the Mayo Clinic campus. The Bio-sciences tower is not dissimilar in height to the office buildings on the Mayo campus immediately to the west and to the buildings on 1st Avenue north of 2"d • Street. This project will have direct access to and be served by the expanded city parking ramp to the south of and bridging 3`d Street. b) Site Design Criteria: 1) Capacity of Public Facilities: Utilities exist adjacent to this project. Some utilities will need to be modified to accommodate this development. The applicant will need to coordinate these modifications or improvements with the appropriate agencies. The Minnesota Department of Transportation has requested a traffic study. 2) Geologic Hazards: Not applicable. 3) Natural Features: Not applicable. 4) Traffic Generation Impact: As a part of this project the existing parking ramp will be expanded. The existing street system is adequate to handle the traffic generated by the project according to the City Public Works Director as stated by the applicant. The City Public Works Director has waived the requirement for a traffic study. • 5) Height Impacts: This project proposes 10 floors with a total • building height of approximately 15.5 feet. Shadows created by the building will fall on commercial structures to the north, northeast and northwest of the site The residential building (old City Hall)east of the project will not be affected except in the late evening by a portion of the parking ramp. The structure is not expected to destroy views from the primary exposures of nearby residential dwelling units (old City Hall). 6) Setbacks: The provisions for the CDC-CBD apply. This building complies with the zoning standard. 7) Internal Site Design: This project is designed to orient retail uses toward 1st Avenue by having its primary and secondary access only to 1st Avenue. The project will provide connection to the existing skyway/subway system from the public parking ramp and the new buildings. 8) Screening and Buffering: Screening and buffering is not required for the project. 9) Ordinance Requirements: The CDC-CBD does not require off- street parking for development projects, however, the applicant is expanding the existing parking ramp south of 3rd St. and extending the ramp to the north for an additional 330-330 parking spaces; and, WHEREAS, the Commission, following its public hearing, recommended approval subject to the following conditions: 1. The Preliminary Development Plan application should address these elements prior to submittal to the City Council: A. Provide a detailed explanation of the choice of building materials and type of glass that will be utilized for the project by fagade and establish the primary choice and the alternate(s). B. Details for the canopies and awnings, including colors and elevations. C. A sign plan if signs will be proposed. D. Identify possible bicycle parking locations in cooperation with the City Transportation Engineer. • 2 • 2. Storm sewer adequacy needs to be determined and addressed through the grading and drainage plan approval process. , 3. All existing water services that will not be reused must be abandoned properly at the main in the street per Rochester Public Utilities requirements. WHEREAS, the Common Council held a public hearing on the Incentive Development R2007-022CUP request on July 16, 2007, and gave all interested persons the opportunity to make presentations and give testimony concerning the application; and, WHEREAS, at the July 16th public hearing, the applicant's representative agreed with all of the recommended conditions of approval; and, WHEREAS, based upon all of the evidence and testimony submitted during the July 16th public hearing, the Council accepts the Planning and Zoning Commission's recommended findings of fact and conditions of approval as amended by the Public Works Department. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that it adopt the Planning and Zoning Commission's findings of fact and that the Incentive Development requested by the City of Rochester is granted subject to the above three conditions. 0 BE IT FURTHER RESOLVED by the Council that this approval involve up to 14 stories for the Bio Business Center and that it waive the final plan review for this project.
