HomeMy WebLinkAboutResolution No. 361-07 u i RESOLUTION WHEREAS, the City of Rochester and Hadley Valley Partners, LLC, have proposed the filling of 0.99 acres of Type 1 and 2 wetlands, out of a total of 9.27 acres of wetlands, on property owned by the City of Rochester that is being transferred to Hadley Valley Partners, LLC, for the development formerly known as Hawthorn Hills. The property is located east of Highway 63, and north and west of CR 148, Hadley Valley Road, N.E. The wetlands consist of floodplain wetlands located along or within the Hadley Creek channel. Wetlands proposed to be filled due to the location. of the single street crossing of the creek within the development and drop structures to stabilize the channel bottom. The applicants propose direct replacement adjacent through the creation of 4.39 acres of new wetlands adjacent to Hadley Creek and development of 1.06 acres of upland buffer along the proposed new wetlands. The total wetland replacement is at a 2:1 replacement ratio and will be 5.45 acres, far in excess of the minimum necessary 1.98 acres of new wetlands; and, • WHEREAS, the Technical Evaluation Panel (TEP) reviewed the application and recommended approval subject to the below described conditions; and, WHEREAS, this matter came before the City of Rochester Common Council on August 6, 2007, for a final decision on the replacement plan. The Council gave all interested parties an opportunity to be heard on this matter and considered all information presented to it including that information found within the Council Agenda packet. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City approve the Wetland Delineation and Replacement Plan presented by the City of Rochester and Hadley Valley Partners, LLC, for the development formerly known as Hawthorn Hills located east of Highway 63, and north and west of CR 148, Hadley Valley Road, N.E. BE IT FURTHER RESOLVED that this approval is subject to the following conditions: 1. The applicants must provide a Declaration of Restrictions and Covenants for Replacement Wetland document covering the replacement area as required by the wetland rules. The applicants should use the standard form provided by the BWSR; and 2. The applicants must schedule timely on-site inspections during the construction of • the wetland replacement area. . The Mayor and the City Clerk are authorized and directed to approve this plan, subject to the above conditions, on behalf of the City.
