HomeMy WebLinkAboutResolution No. 416-07 7 • RESOLUTION. WHEREAS, B'nai Israel Synagogue applied for an Incentive Development (#04-46) to permit the construction of a new 14,600 square foot synagogue on the property and a 14 stall parking lot north of the alley. The property is located along the north side of Second Street S.W., along the east side of Seventh Avenue S.W., and along the south side of First Street S.W.; and, WHEREAS, R.C.O. § 62.630 provides the criteria for incentive developments against which this application must be analyzed; and, WHEREAS, on July 25, 2007, the Rochester Planning and Zoning Commission held a public hearing on this final plan, reviewed the application according to the criteria in R.C.O. § 62.630(2), and suggested the following findings of fact: Final Development Plan Criteria: a) Public Facility Design: N/A. b) Geologic Hazard: N/A. • c) Access Effect: The new access will be from the existing alley and 7th Ave rather than directly to 1st St. which will reduce travel from 1st St to/from the parking lot. d) Pedestrian Circulation: N/A. e) Foundation and Site Plantings: The applicant has proposed boulevard trees and trees on the west side of the parking lot, a hedge on the east side and trees and hedge in the island. The applicant proposes variances to the required setbacks. A bufferyard standard "D" and "S2" applies to the parking lot. f) Site Status: The applicant has obtained the property and therefore will have direct control over long term maintenance. g) Screening and Bufferyards: Bufferyard standards apply to the parking lot. Variances are addressed in this application and report. Conditions of approval are recommended that address the landscaping of the parking lot. h) Final Building Design: N/A. 1 • i) Internal Circulation Areas: The applicant has placed all circulation for the parking within the lot and the adjacent alley eliminating the direct access onto First Street, SW, and reducing the need to utilize First Street as the primary access. j) Ordinance Requirements: Action on the variances will address the applicable ordinance requirements; and, WHEREAS, the Rochester Planning and Zoning Commission recommended approval subject to the following conditions: 1. The conditions placed on the original application 2004-46 shall apply to this application. 2. The two parcels north of the alley shall be joined into one universal parcel/deed through the County Recorder's Office. 3. Additional landscaping along the west and north property lines must be included in the landscaping plan. The landscaping must include the proposed boulevard trees, and trees on the west side of the parking lot as shown on the submitted landscape plan, and, in addition, a hedgerow on the north and west sides of the parking lot. The plant material chosen for • the hedgerow must meet the standards of Section 63.150 and of a species that will grow to 4 feet in height. 4. The island is located partially within the alley right of way. The island must be removed from the alley right of way. 5. Concrete curbing shall be installed along the alley to create two one-way accesses and drive aisles meeting the standards of R.C.O. §63.454. The curbing shall be located on the private property. WHEREAS, the Common Council held a public hearing on the incentive development preliminary plan request on August 20, 2007, and gave all interested persons an opportunity to give testimony and make presentations; and, WHEREAS, the Applicant's representative appeared at the public hearing and testified that the Applicant agreed with all of the above conditions. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that it adopt the Planning and Zoning Department's findings of fact.. and recommended conditions of approval, and that Incentive Development #04-46 requested by B'nai Israel Synagogue to permit the construction of a new 14,600 square foot synagogue on the property and a 14 stall parking lot north of the alley is granted subject to the above five _ • conditions. • PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA, THIS OF , 2007.
