HomeMy WebLinkAboutResolution No. 592-07 RESOLUTION WHEREAS, the Williams Family Partnership has proposed the filling of 2.76 acres of Type 1 wetlands located east of South Broadway and the Shopko Store, and west of Willow Creek. The Type 1 wetlands consist of floodplain wetlands located in the floodplain of Willow Creek. Wetlands are proposed to be filled and dredged due to city requirements for floodplain elevation requirements, stormwater control requirements, future surrounding development pattern, and street and utility extensions; and, WHEREAS, the applicant proposed direct replacement in Olmsted County in the Root River watershed north of Chatfield through the restoration of 2.3 acres of wetlands on property adjacent to Mill Creek, revegetation of 10.1 acres (2.52 acres of credit) existing wetlands at the same site, and development of 2.5 acres of upland buffer along the proposed new wetlands. The total wetland replacement is above the 2.5:1 replacement ratio and will be a total of 7.3 • acres, which is above the minimum necessary 6.9 acres for wetland replacement; and, WHEREAS, the Technical Evaluation Panel (TEP) reviewed the application and recommended approval subject to the below described conditions: 1. The applicant must provide a Declaration of Restrictions and Covenants for Replacement Wetland document covering the replacement area as required by the wetland rules. The applicant should use the standard form provided by the BWSR; 2. The applicant must schedule timely on-site inspections during the construction of the wetland replacement area; and, 3. The applicant must submit an annual monitoring plan until the TEP has determined that the wetland replacement requirements have been fulfilled; and, WHEREAS, this matter came before the City of Rochester Common Council on December 19, 2007, for a final decision on the replacement plan. The Council gave all interested parties an opportunity to be heard on this matter and considered all information presented to it including that information found within the Council Agenda packet. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of • Rochester that the City approve the Wetland Delineation and Replacement Plan presented by the Williams Family Partnership located east of South Broadway and the Shopko Store, and west of Willow Creek subject to the above three conditions. •�^ The Mayor and the City Clerk are authorized and directed to approve this plan on behalf of the City.
