HomeMy WebLinkAboutResolution No. 294-08 `, z • RESOLUTION WHEREAS, First Presbyterian Church applied for an Incentive Development (#2008-001) to permit the construction of an addition to the church which exceeds the allowable floor area. The property is located along the south side of Third Street S.W., and along the east side of Sixth Avenue S.W.; and, WHEREAS, R.C.O. § 62.630 provides the criteria for incentive developments against which this application must be analyzed; and, WHEREAS, on May 14, 2008, the Rochester Planning and Zoning Commission held a public hearing on this final plan, reviewed the application according to the criteria in R.C.O. § 62.630(2), and suggested the following findings of fact: Final Development Plan Criteria: a) Public Facility Design: The existing utilities serving the site are adequate to serve the proposed addition. b) Geologic Hazard: There are no known geologic hazards related to this • project. c) Access Effect: Modifications to the existing parking lot is planned which includes a new access point on 3rd Street SW with the existing 2 accesses being removed and the boulevard being restored. The northerly most access opening on 6th Avenue SW will be removed and the portion of the parking lot currently located within the right-of-way will be moved out of the right-of-way. A 3 foot wide landscape area is proposed to be added along the north and west sides of the parking lot. d) Pedestrian Circulation: There is a planned sidewalk that will connect the new entrance on the west side of the church to 3rd Street SW. The condition of the existing sidewalks along the frontages of the property will be reviewed by Public Works staff and any needed repairs or section replacement will be done concurrent with the construction of the addition. e) Foundation and Site Plantings: A landscape plan for the site has been prepared which indicates the finished site will be consistent with the landscape character of the surrounding area. f) Site Status: The entire property is under the ownership of the church and all maintenance of the buildings and landscaping is the responsibility of • the church. Construction plans for utilities must be prepared by an engineer and be submitted to and approved by the City prior to 1 • construction. An Owner Contract will be required for construction of any new public infrastructure required. The proposed use is compatible with the existing land uses in the area and the church has been at this location for approximately 75 years. The proposed renovations to existing church campus will not only enhance the church property but also the surrounding neighborhood. g) Screening and .Bufferyards: According to the landscaping plan provided there will be an abundant amount of landscaping on the property. h) Final Building Design: The final building design is consistent with the principles identified in preliminary development plan relative to Height Impact, Setbacks, and Internal Site Design. i) Internal Circulation Areas: Modifications to the existing parking lot is planned which includes a new access point on 3rd Street SW with the existing 2 accesses being removed and the boulevard being restored. A 3 foot wide landscape area is proposed to be added along the north and west sides of the parking lot. • j) Ordinance Requirements: The proposed project is exceeding the required on-site parking spaces by 7. The existing landscaping area is only 20% which is 10% below the requirement. With the proposed addition the amount of landscape remains at 20% because of the landscape being added along the north side of the parking lot; and, WHEREAS, the Rochester Planning and Zoning Commission recommended approval subject to the following conditions: 1. A grading plan approval and payment of a Storm Water Management Area Charge is applicable for any increase in impervious surface. 2. The owner shall remove any remaining driveway approaches and restore the curb and boulevard. The condition of existing concrete sidewalk and curb and gutter along the frontages of this property shall be reviewed by the Public Works staff and any needed panel repair and/or replacement work of sidewalk shall be done concurrent with the building expansion. 3. Metes and Bounds #R2008-002MB must be recorded. The lots need to be combined as one lot with the Olmsted County Recorder's Office prior to development; and, • 2 • WHEREAS, the Common Council held a public hearing on the incentive development preliminary plan request on June 2, 2008, and gave all interested persons an opportunity to give testimony and make presentations; and, WHEREAS, the Applicant's representative appeared at the public hearing and testified that the Applicant agreed with all of the above conditions. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that it adopt the Planning and Zoning Department's findings of fact and recommended conditions of approval, and that Incentive Development #R2008-001CUP Final Plan requested by First Presbyterian Church to permit the construction of an addition to the church which exceeds the allowable floor area is granted subject to the above three conditions.
