'...wr.e, u......' .....t......... a..._w..�w.u u..uuw....r.rw..«...mw..w...n.uuu..+w..0 w.m.a u.w...w.....0.ie..,..,.r ...r...u...u..wv..ue .as..s.e a..n.arr.6.....»..:•n,..tr..a.a.+.......a..au..e........,uu .......+.a.. ..e .e... • RESOLUTION WHEREAS, Kiehm Construction, Inc., applied for a Type III, Phase II Incentive Development (#R2008-018CUP) to permit the construction of a three story, climate controlled and secured self-storage facility along the north side of Eastwood Road S.E. The proposed building exceeds the allowable floor area ratio within the B-4 Zoning District. The property is located along the north side of Eastwood Road S.E., and east of the Bear Creek Post Office; and, WHEREAS, R.C.O. §62.630 sets forth the criteria for incentive developments; and, WHEREAS, based upon section 62.630, the Planning and Zoning Commission recommended the following findings of fact: Preliminary Development Plan Criteria: a) Suitability of the Area: The proposed site is suitable as the location for an Incentive Development. The proposed use is compatible with the existing land uses in the area. The B-4 zoning district is adjacent to the west and • north of the project site. R-1 (Mixed Single Family Residential) is located to the south and east of the property and is located well above the site in elevation. Providing retaining walls will remove many of the steep slopes that currently show signs of erosion. Additionally, providing the retaining walls along Eastwood Road will allow for reconstruction of Eastwood Road by the City of Rochester without encroaching into the property. This also allows for construction of the 10' bituminous pedestrian facilities. b) Site Design Criteria: 1) Capacity of Public Facilities: Utilities are available to this project. Execution of a City-Owner Contract will be required for the extension of public watermain and/or the addition of hydrants that are required for the proposed development. At least two on-site fire hydrants shall be provided on the property. The required on- site fire hydrants shall be shown on the final plan along with the connecting mains and the water service to the building in an approved location per City Public Utilities —Water Division. 2) Geologic Hazards: There are no geological hazards identified on • the site. • 3) Natural Features: By utilizing retaining walls and an underground stormwater treatment on the proposed site will allow maximizing an increased amount of landscape area. 4) Traffic Generation Impact: Self storage facilities are near the lowest usage of traffic generation for commercial development. The proposed project will have no adverse impact of traffic generation. 5) Height Impacts: There are no residential lots affected by this development. Due to the changing topography, the proposed structure will not destroy views of adjacent residential development. 6) Setbacks: The proposed addition complies with all required setbacks. 7) Internal Site Design: As shown on the preliminary plan, parking stall #1 does not meet dimension standards and the use of this stall would require vehicles to drive opposite the "One-Way" traffic flow. The Final Plan will need to include a revised location and size of the parking stall. • 8) Screening and Buffering: The bufferyard described on the preliminary plan meets the requirements of the Land Development Manual for Self Service Storage Facilities. Detailed description of the bufferyard shall be included in the final plan. 9) Ordinance Requirements: The Final Plan will need to indicate the number of storage units that will be provided. At that time, a determination for the location and number of parking spaces required can be determined. The proposed project will provide an additional 10% of landscape area, totaling 20%; and, WHEREAS, the Commission, following its public hearing, recommended approval subject to the following conditions: 1. The final development application plan shall include: A. Elevation Plans of the proposed development. B. A revised site plan indicating the location of two additional on-site fire hydrants along with the connecting mains and the water service to the building in an approved location as determined by Rochester Public Utilities-Water Division. • C. Landscape Plans including description of bufferyards. 2 • D. The total number of storage units and number and location of parking stalls. 2. Separate Grading Plan approval is required and payment of a Storm Water Management Area Charge is applicable for any increase in impervious surface. 3. Execution of a City-Owner Contract shall be required for the extension of public watermain and the additional two on-site fire hydrants. 4. The mechanical entrance gates shall be provided with a Fire Department Knox Box Key Cylinder to open the gates as needed during emergency response to the facility. 5. Upon approval by the City Council for the Substantial Land Alteration, the applicant shall provide surety that guarantees the site will be fully restored after the completion of the excavation activity, unless the restoration cost for said work is included in and identified separately in the City-Owner Contract Bonds. Said surety must be provided prior to commencement of grading activities on the property. If the City Council denies the Substantial Land Alteration, the grading plans shall be returned to the • designers for reevaluation. WHEREAS, the Common Council held a public hearing on the Incentive Development R2008-018CUP request on June 16, 2008, and gave all interested persons the opportunity to make presentations and give testimony concerning the application; and, WHEREAS, at the June 16th public hearing, the applicant's representative agreed with all of the recommended conditions of approval; and, WHEREAS, based upon all of the evidence and testimony submitted during the June 16th public hearing, the Council accepts the Planning and Zoning Commission's recommended findings of fact and conditions of approval. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that it adopt the Planning and Zoning Commission's findings of fact and that the Incentive Development requested by Kiehm Construction, Inc., is granted subject to the above five conditions. • 3 PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA, THIS Itt 0) DAY OF , 2008.
