HomeMy WebLinkAboutResolution No. 353-08 y r • RESOLUTION WHEREAS, WV, Limited Partnership, a Minnesota limited partnership, and Home Federal Savings Bank, a federally chartered stock savings bank, mortgagee, owners and proprietors, have shown to the satisfaction of the City of Rochester Common Council that it has complied with all conditions of approval imposed upon its Land Subdivision Permit (Preliminary Plat) and all applicable laws and ordinances; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that after a hearing duly noticed and held on July 7, 2008, the following plat of lands in Olmsted County, Minnesota are to be known and designated as follows: Part of Lot 97 and 98, AUDITORS PLAT "B", according to the plat thereof on file at the County Recorder's office, Olmsted County, Minnesota, and part of vacated 10th Avenue N.W., described as follows: • Commencing at the northwest corner of the Northwest Quarter of Section 35, Township 107 North, Range 14 West; thence southerly on a Minnesota State Plane Grid Azimuth from north of 180 degrees 02 minutes 07 seconds along the west line of said Northwest Quarter 1402.70 feet; thence easterly 91 degrees 02 minutes 07 seconds azimuth 33.00 feet to the northwest corner of Lot 1, Block 1, NORTHGATE PLAZA FIRST SUBDIVISION, according to the plat thereof on file at said County Recorder's office; thence easterly 91 degrees 02 minutes 07 seconds azimuth along the north line of said Lot 1, a distance of 386.14 feet to the westerly line of said Lot 1; thence northerly 00 degrees 02 minutes 07 seconds azimuth along said westerly line 259.37 feet to the westerly extension of the southerly right—of—way line of 10th Street N.W. as platted immediately north of Block 7, CASCADE SUBDIVISION, according to the plat thereof on file at the County Recorder's office, Olmsted County, Minnesota; thence westerly 270 degrees 02 minutes 07 seconds azimuth along said westerly extension line 16.50 feet to the westerly right—of—way line of 10th Avenue N.W.; thence northerly 00 degrees 02 minutes 07 seconds azimuth along said westerly line 19.05 feet to the southerly right—of—way line of 10th Street .N.W. as platted immediately south of Block 5 of said CASCADE SUBDIVISION, said line also being the northerly line of said Lots 97 and 98; thence westerly 269 degrees 36 minutes 05 seconds azimuth along said line 369.59 feet to the easterly right—of—way line of 11 th Avenue N.W.; thence southerly 180 degrees 02 minutes 07 seconds azimuth along said easterly right—of—way line 268.88 feet to the point of beginning. Said tract contains 2.42 acres more or less. • TO BE KNOWN AS WASHINGTON VILLAGE, submitted by WV, Limited Partnership, a Minnesota limited partnership, and Home Federal Savings Bank, a federally chartered stock savings bank, mortgagee, owners and proprietors, is hereby approved and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA, THIS :Z H DAY OF C ay 20_0t.
