RESOLUTION
WHEREAS, Kiehm Construction Inc., applied for an Incentive Development (#R2008-
018CUP) to permit the construction of a three-story, climate controlled, secured, self storage
facility along the north side of Eastwood Road S.E. The proposed building exceeds the
allowable floor area ratio within the B-4 zoning district. The property is located along the north
side of Eastwood Road S.E., and east of the Bear Creek Post Office; and,
WHEREAS, R.C.O. § 62.630 provides the criteria for incentive developments against
which this application must be analyzed; and,
WHEREAS, on June 25, 2008, the Rochester Planning and Zoning Commission held a
public hearing on this final plan, reviewed the application according to the criteria in R.C.O. §
62.630(2), and suggested the following findings of fact:
Final Development Plan Criteria:
a) Public Facility Design: Utilities are available to this project. The Owner
• is required to enter into a City-Owner Contract with the City of Rochester
for the installation of the public water main. Final water construction plans
with profiles must be prepared by a civil engineer, approved by RPU-
Water Division and conform to the standard City of Rochester
requirements.
b) Geologic Hazard: There are no known geologic hazards related to this
project.
c) Access Effect: The proposed project will share an access with the
adjacent utility building to the west thereby reducing the number of curb
cuts onto Eastwood Road S.E.
d) Pedestrian Circulation: A Contribution & Pedestrian Facilities Agreement
has been executed for this Property to address the Owner's obligation for
future reconstruction of Eastwood Road SE and construction of
Pedestrian Path along the frontage of the Property.
e) Foundation and Site Plantings: A landscape plan for the site has been
prepared indicating the finished site will be consistent with the area
including the additional 10% of landscape area over the minimum
requirement of 10% of landscaped area.
• f) Site Status: The entire property is under one owner and all maintenance
of the buildings and landscaping is the responsibility of the owner. The
project includes the staffing of two employees on site. Construction plans

for utilities must be prepared by an engineer and submitted and approved
by the City prior to construction.
g) Screening and Bufferyards: The project consists of providing 21 canopy
and 35 understory trees, 75 shrubs and fencing meeting the requirements
of a Type "G" bufferyard along Eastwood Road SE and a Type "F"
bufferyard along the northerly portion of the east property line. The
proposed project is providing a 20% landscape area, exceeding the
required landscape area by 10%.
h) Final Building Design: The final building design is consistent with the
principles identified in preliminary development plan relative to height
impact, setbacks and internal site design.
i) Internal Circulation Areas: Plans for off-street parking and loading areas
and circulation aisles to serve this project meet ordinance requirements in
terms of design. A total of five parking spaces will be provided on site as
required for two employees and 578 storage units.
j) Ordinance Requirements: Applying requirements in the B-4 (General
Commercial) zoning district, the setbacks, exterior lighting, sign
• regulations and landscaping requirements appear to be consistent with
said requirements; and,
WHEREAS, the Rochester Planning and Zoning Commission recommended approval
subject to the following conditions:
1. Prior to the issuance of a building permit:
A. The final water main construction plans with profiles must be
prepared by a civil engineer, approved by RPU-Water Division and
conform to standard City of Rochester requirements.
B. The 20-foot utility easement shown on the final plan must be
dedicated to the City of Rochester.
C. Two six-inch gate valves and boxes are required; one for the hydrant
and one for the fire service line.
D. There shall be four protective posts around the fire hydrant.
2. The mechanical entrance gates shall be provided with a Fire Department
Knox Box Key Cylinder to open the gate as needed during emergency
• response to the facility.

3. Separate Grading Plan approval is required and payment of a Storm
Water Management Area Charge is applicable for any increase in
impervious surface.
4. The Execution of a City-Owner Contract is required for the installation of
the public water main.
5. An official E911 Address will be required for this property/building. Any
existing 911 Addressing associated with the building and property will
need to be validated by contacting Planning Department— GIS staff; and,
WHEREAS, the Common Council held a public hearing on the incentive development
preliminary plan request on July 21, 2008, and gave all interested persons an opportunity to give
testimony and make presentations; and,
WHEREAS, the Applicant's representative appeared at the public hearing and testified
that the Applicant agreed with all of the above conditions.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that it adopt the Planning and Zoning Department's findings of fact and
recommended conditions of approval, and that Incentive Development #R2008-018CUP Final
Plan requested by Kiehm Construction, Inc., to permit the construction of a three-story, climate
controlled, secured, self storage facility along the north side of Eastwood Road S.E., is granted
subject to the above five conditions.
