RESOLUTION
WHEREAS, MSIR 6 LLC, a Minnesota limited liability company, and Home Federal Bank, a
federally chartered stock savings bank, mortgagee, owners and proprietors, have shown to the
satisfaction of the City of Rochester Common Council that it has complied with all conditions of
approval imposed upon its Land Subdivision Permit (Preliminary Plat) and all applicable laws
and ordinances;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on July 21, 2008, the following plat of
lands in Olmsted County, Minnesota are to be known and designated as follows:
Lot 1, Block 1, WILLOW CENTER SUBDIVISION, according to the plat thereof on file at the
County Recorder's office, Olmsted County, Minnesota; TOGETHER WITH that part of the
now vacated public right—of—way, formerly known as 36th Street S.W., lying westerly of
the westerly right—of—way line of MINNESOTA DEPARTMENT OF TRANSPORTATION RIGHT OF
WAY PLAT NO. 55-45, northerly of the north line of said Lot 1, easterly of the northerly
extension of the west line of said Lot 1 and southerly of the north line of the
Southeast Quarter of Section 23, Township 106 North, Range 14 -West, said Olmsted
County.
• Said tract contains 10.37 acres more or less.
TO BE KNOWN AS WILLOW CENTER SECOND SUBDIVISION, submitted by MSIR 6 LLC, a
Minnesota limited liability company, and Home Federal Bank, a federally chartered stock
savings bank, mortgagee, owners and proprietors, is hereby approved and all dedications of
land or interests in land for public purposes as shown on said plat are hereby accepted
PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF ROCHESTER,
