The City Council adopted various policies for the collection of charges related to public investment for public facilities as they relate to the development of vacant property and the reconstruction of existing facilities for developed properties. These policies have an adjustment factor that is modified annually based on the change in the Engineering News Record Construction Cost Index(ENR CCI) for Minneapolis. The changes reflected in this publication represent the changes for the cost of providing the infrastructure(construction cost). From August 1,2007 to August 1,2008 the ENR cost index has risen 6.4 %. THE RATES OUTLINED HEREIN ARE FOR REFERENCE ONLY AND SHOULD NOT BE USED INDEPENDENT OF THEIR CORRESPONDING POLICIES OUTLINING APPLICABILITY AND/OR PAYMENT • REQUIREMENTS. Applying this adjustment to the charges collected by the City results in the following adjusted charges to be effective for projects resulting in payments 8/1/08 through 7/31/09: Alternative Sewer and Water Connection Charge Policy(per foot of frontage) Sanitary Sewer and Watermain Connection Charge $100.67 Sanitary Sewer Only $57.31 Watermain Only $51.10 Sewer or Water per Centerline Foot $73.80(through undeveloped property) The 2009 adjusted maximum connection fee shall be as follows: 1. $12,391.80 per lot for any developed lot one-half acre or less that contains a habitable single family dwelling unit. 2. $12,391.80 per lot plus $0.28446/square foot over one-half acre and one and one-half acres that contain a habitable single family dwelling unit. 3. $24,783.60 per lot one and one-half acres or larger that contains a habitable single family dwelling unit. NOTE:Ton ens property is charged the actual cost of recording plus the Document Review Fee) Assessment Interest Rate for-projects as set by Council Action 2009 rate is 6.0% 4 RESOLUTION BE IT RESOLVED by the Common Council of the City of Rochester that the City grant a revocable permit to Rock Partners, LLC, the owner of the property described as Lots 6 & 7, Block 1, Seehusen Industrial Park for the placement of a business sign that will project over the 14-foot utility easement located within said Lot 6 for the construction of the new Nietz Electric location. • BE IT FURTHER RESOLVED that the granting of the revocable permit is subject to the following conditions: 1. Permittee will install and maintain the business sign at its own expense. 2. Permittee will be responsible for the cost to remove and reinstall the business sign, if necessary, as well as any damages to public facilities. 3. Permittee must pay $112.12 to the City for document preparation and recording; 4. Permittee is responsible for all costs for the installation, maintenance and repair of the encroachment; 5. Permittee must hold the City harmless, by insurance coverage or by agreement, and must defend and indemnify the City for any and all damages resulting from its use of the City's property and rights-of-way; 6. Permittee must execute any document required by the City Attorney's Office prior to delivery of the permit; 7. Permittee must remove the encroachment from the City's property at its own cost • should the City make such a request. Should the City remove the encroachment, Permittee shall reimburse the City for any costs the City incurs; 1 r 8. Permittee will not to seek any relocation costs or other damages from the City for any reason should Permittee be required to remove the encroachment from the City's property; and 9. This permit may not be assigned without the City's approval. The Mayor and the City Clerk are authorized and directed to execute the revocable permit, subject to the above conditions, on behalf of the City.
