BE IT RESOLVED by the Common Council of the City of Rochester that the City adopt a
personnel policy regarding employment requirements. A copy of the policy is attached.

• EMPLOYMENT REQUIREMENTS
A. Applicants on City Pensions
1. Any retired City employee (regardless of age) who has been in a retired status for thirty
(30) days or longer may be eligible for"substitute" employment with the City.
2. In order to qualify for temporary employment, the retired employee must be physically
and mentally capable of performing the required duties of the position applied for.
3. It is the employee's obligation to be aware of the earnings impact by Public Employees'
Retirement Association benefits and Social Security Administration relative to earnings
received prior to retirement.
4. An alternative procedure of contracting with the retired employee as a consultant is
available when appropriate and approved by the department head.
B. Pre-employment Physical Examinations
1. New employees, for specific job classifications, shall be required to pass a physical ex-
amination before employment. Such examinations shall be at the City's expense and
shall be given by a licensed, qualified physician who may be designated by the City.
2. Arrangements for all pre-employment medical examinations will be made by the Hu-
man Resources Department.
C. Employees being hired to fill positions which require a large amount of physical activity may
be required to pass additional tests which are job related.
D. Probationary Period
1. The first six (6) months of employment as a regular employee shall be utilized for ob-
serving the employee's work, for securing the most effective adjustment of the em-
ployee to his/her position, and for terminating any employee whose performance does
not meet the required work standards. The Department Head/Supervisor of each new
employee shall be required to submit to the Human Resources Department a written
rating of the performance of each new employee on forms supplied by the Human Re-
sources Department. These ratings will be submitted two (2)times during the proba-
tionary period, at the end of the first three (3) months and again fifteen days prior to the
end of the probationary period.
2. Vacation benefits shall be earned, but may not be used until after the completion of the
probationary period. Probationary employees may be granted a leave of absence not
to exceed five (5) days during the probationary period. If employment is terminated by
either the employer or the employee during the probationary period, there shall be no
sick leave, vacation or other benefits due to the employee.
3. Probationary employees shall be subjected to the same policies as full-time em-
ployees. In the case of those policies which relate to required time off, i.e.jury duty,
military training, etc., a probationary employee who is required to participate shall have

• his/her probationary period extended an equal number of working days for the purpose
of evaluation.
E. Outside Employment
The Common Council does not encourage outside work by City employees. Each depart-
ment shall be responsible for the regulation of outside work by its employees in accordance
with the following policy:
1. Whenever a person accepts employment with the City, his/her first responsibility shall
be to the City and to the efficient fulfillment of the duties to which he/she has been as-
signed. The City offers no objection to an employee accepting outside work providing
that it is done outside of regular hours with the City, and the work is of such a nature
that it will in no way affect the objective judgment or the efficient performance of his/her
regular duties with the City such as overtime, on-call, etc., and will in no way cause
him/her to become an accident hazard through fatigue, worry or other conditions aris-
ing from such outside work.
2. Department heads shall be responsible for the monitoring of outside work, using a
maximum of twenty (20) hours per week as a guideline.
3. The City will not permit any employee to use its materials, equipment, supplies, tools or
transportation in outside employment. Violation of this policy may be cause for termi-
nation.
• 4. There shall be no Worker's Compensation or sick leave payments to any individual in-
jured in the course of outside employment.
F. Veteran's Preference
Preference shall be accorded veterans pursuant to applicable state law. The Veteran's
Preference Law is summarized as follows, but the law itself shall govern the granting of
veteran's preference by the City.
Veteran's Preference is applicable in cases where an open competitive examination is giv-
en.
A Veteran's Preference shall be available to every person who has been separated under
Honorable conditions from any branch of the armed forces of the United States: a) after
having served on active duty 181 consecutive days, or b) by reason of disability incurred
while serving on active duty, and c) a citizen of the United States or a resident alien.
Veterans thus preferred shall not be disqualified from holding any position on account of
age or by reason of any physical disability provided such age or physical disability does not
render them incompetent to perform duties of the position.
1. Entrance Examinations
Non-disabled veterans, after receiving a passing grade may elect to receive a credit of
five (5) points to augment their passing rate.

2. Disabled Veteran (Any Disability Rating)
After receiving a passing grade the disabled veteran may elect to receive a credit of ten
(10) points to augment their passing rate. The above credits may be used each time
an entrance examination is taken.
3. Promotional Examination
Non-disabled Veterans (No Preference)
Disabled Veterans —(Rating of 50% of more) receiving a passing grade in their first
promotional examination may elect to receive a credit of five (5) points to augment their
rating. This credit may be used only once and only in case of first promotion.
The City of Rochester Policy on Veteran's Preference is subject to change to comply with
the most recent law.
