HomeMy WebLinkAboutResolution No. 558-08 7 T 7 Z .1 L --Ink • RESOLUTION BE IT RESOLVED by the Common Council of the City of Rochester that the City purchase land from Mortenson Properties, Inc., for the needed permanent easement for the extension of a bike path along the Highway 52 West Frontage Road from the north side of 41st Street N.W., to the existing pedestrian facility on the North Wal-Mart site just south of 55 th Street N.W. (J4602) in the amount of$5,000. BE IT FURTHER RESOLVED that it is the judgment of the Common Council that the purchase of the real property covered by this resolution has no relationship to the City's comprehensive plan. As such, the Council hereby dispenses with the requirement of Minnesota Statute Section 462.356, Subd. 2 that might require the City Planning and Zoning Commission to perform a comprehensive plan compliance review of the action described by this resolution. BE IT FURTHER RESOLVED that the Common Council determines the purchase and sale of the real property covered by this resolution would promote the public's health, safety or welfare. The Mayor and City Clerk are authorized to execute the purchase agreement with Mortenson Properties, Inc., and any other documents needed to implement this resolution on behalf of the City.
