HomeMy WebLinkAboutOrdinance No. 4496 - Ordinance Zoning Map Amendment CD2023-003ZC by West 80 Properties, LLC ORDINANCE NO. ______ ORDINANCE REZONING APPROXIMATELY 74 TOTAL ACRES OF LAND FROM BP BUSINESS PARK TO R-2 LOW-DENSITY SMALL LOT AND R-3 MEDIUM DENSITY RESIDENTIAL AND AMENDING ORDINANCE NO. 4478, KNOWN AS THE UNIFIED DEVELOPMENT CODE OF THE CITY OF ROCHESTER, MINNESOTA. THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN: Section 1. Upon public hearing duly noticed and held, Ordinance No. 4478 as amended, known as the Unified Development Code of the City of Rochester, Minnesota, is hereby further amended as follows: The Zoning Map of the City of Rochester as adopted by said Ordinance No. 4478 establishing the various zoning districts and boundaries thereof is amended by rezoning the following described lands to the district indicated: R-2 That part of Outlot A, VALLEYHIGH BUSINESS PARK, according to the recorded plat thereof, Olmsted County, Minnesota, lying south of the following described line: Commencing at the southwest corner of said Outlot A; thence North 00 degrees 11 minutes 28 seconds West, assumed bearing along the west line of said Outlot A, a distance of 178.86 feet to the point of beginning of the line to be described; thence North 89 degrees 47 minutes 44 seconds East 1273.51 feet to the east line of said Outlot A, and said line there terminating. AND The Southeast Quarter of the Southeast Quarter (SE ¼ SE ¼) of Section 19, Township 107 North, Range 14 West, Olmsted County, Minnesota. Containing 43 acres, more or less. R-3 That part of Outlot A, VALLEYHIGH BUSINESS PARK, according to the recorded plat thereof, Olmsted County, Minnesota, lying north of the following described line: Commencing at the southwest corner of said Outlot A; thence North 00 degrees 11 minutes 28 seconds West, assumed bearing along the west line of said Outlot A, a distance of 178.86 feet to the point of beginning of the line to be described; thence North 89 degrees 47 minutes 44 seconds East 1273.51 feet to the east line of said Outlot A, and said line there terminating. Containing 30 acres, more or less. Section 2. EFFECTIVE DATE. This ordinance shall become effective upon the date of its publication.
