Home My WebLink AboutResolution No. 128-23 - Resolution - Membership of Matthew Clemens Police & Fire Plan of PERA After Promotion to Assistant Fire Marshal RESOLUTION Authorizing the Continued Membership of Matthew Clemens within the Police & Fire Plan of the Public Employees Retirement Association (PERA) After Promotion to Assistant Fire Marshal. WHEREAS, Minnesota Statutes Section 353.64, Subd. 5(a) permits the governing body of a governmental subdivision to continue membership of a Police and Fire member in the Public Employees Police and Fire Plan (the plan) that has transferred or will be transferring to a different position with associated Police or Fire Department functions within the same department or a related department within the same governmental subdivision. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester that the position titled Assistant Fire Marshal, currently held by Matthew Clemens, meets all of the required Police and Fire membership requirements to qualify for the stated continuation of membership in the plan after promotion from the position of Motor Operator, including: 1. The position to which this employee has been transferred/promoted has associated fire functions in the same department or a related department within this same governmental subdivision, and 2. Said position is not that of an elected or appointed position of the City Council, City Manager, or Finance Director. BE IT FURTHER RESOLVED that this governing body hereby requests that the above-named employee be allowed to continue as a member of the Public Employees Police and Fire Plan until date of termination for this position.
