RESOLUTION
Approving Land Use Amendment No. CD2023-002CPA, To Amend the
Comprehensive Plan Land Use Map On 43.76 Acres, Generally Situated at the
Northeast Corner of 55th St NW and 18th Ave NW from LDR (Low Density
Residential) to 20 Acres of MDR (Medium Density Residential) and 25 Acres of CBD
(Commercial and Business Development).
WHEREAS, the development of the P2S Rochester 2040 Comprehensive Plan is the
accumulation of multi-year process, grounded in significant research, data analysis,
community input, and consideration of alternative solutions to facilitate growth in the City of
Rochester, and,
WHEREAS, the Common Council of the City of Rochester by enactment of Resolution 147-
18 on April 16, 2018 duly adopted the P2S Comprehensive Plan, including a “LAND USE
PLAN" map as part said plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, the P2S Comprehensive Plan limits a property owner initiated Land Use Plan
Amendment to a maximum size of 10 acres, and
WHEREAS, on February 6, 2023, the City Council directed the Development Services
Review Team to analyze the subject 120 acre property for potential amendment of the
land use plan designations from LDR to MDR and CBD classifications; and
WHEREAS, Section 3 of the P2S Comprehensive Plan establishes 9 Criteria to be utilized
when evaluating a Land Use Plan amendments to determine consistency with the
adopted P2S Comprehensive Plan; and
WHEREAS, the Development Services Team applied the 9 Criteria in exploration of the
proposed amendment and provides a recommendation based in: multi-family project
pipeline data, projected housing needs identified by the Maxfield Housing Study, the City
of Rochester TOD Study, Vacant MXT Zoned Property Inventory, Vacant multi-family land
use inventory within Rochester, vacant land inventory designated for multi-family
residential located in “Near Term Urban Expansion” areas near utilities, P2S
Comprehensive Plan Goals and Objectives; and the P2S Comprehensive Plan Land Use
& Transportation Framework; and
WHEREAS, the Development Services Team finds a moderate change to the Land Use
Plan map to MDR and CBD will make better use of previous infrastructure investment,
and generally compatible with surroundings, and
WHEREAS, Development Services Team has determined that an amendment of more
than 20 acres to MDR and 25 acres of CBD is inconsistent with the adopted P2S
Comprehensive Plan Amendment Criteria, finding the City has sufficient lands for multi-
family based development based on the land inventory analysis and needed units
identified in the Maxfield Study, and
WHEREAS, Development Services finds that amending more than 20 acres to MDR and
25 of CBD at this location is inconstant with the strategies identified in the comprehensive
plan to implement a Primary Transit Network (PTN) for high quality and high frequency
rapid transit lines on identified corridors accessing downtown Rochester and facilitating
Destination Medical Center efforts, and
WHEREAS, after published notice and holding a public hearing, the Rochester Planning
Commission recommend that the City Council APPROVE a land use amendment, changing
the classification on 45 acres of Low Density Residential land to 20 acres of Medium Density
Residential land and 25 acres of Commercial and Business Development land , and
WHEREAS, the Common Council, after published notice, held a public hearing on the
matter of the proposed amendment to said "LAND USE PLAN;" and
WHEREAS, the City Council has determined that the land use plan amendment, as
prepared by the Community Development and recommended by the Planning Commission,
satisfies the 9 criteria applicable to amendments of the Land Use Plan, based upon the
findings presented by the Community Development Department.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that the "LAND USE PLAN" as adopted in 2018, and as thereafter amended, is hereby
further amended by changing the designations on 45 acres of property, per the “Proposed
Land Use Map” prepared by Community Development Department for Application CD2023-
002CPA, located in Township 107 North, Range 14 West, Section 10, Olmsted County,
Minnesota:
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained in
the office of the Community Development Department of the City of Rochester and shall be
available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified copy
of this resolution in the office of the County Recorder in and for Olmsted County, Minnesota.
