RESOLUTION
WHEREAS, the Common Council of the City of Rochester by enactment of Resolution
143-80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive
municipal plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, Castle Court MN Limited Partnership initiated an amendment to the
Rochester Urban Service Area Land Use Plan to change the land use plan designation for
property bounded by Second Street S.W., Third Street -S.W., 19th Avenue S.W., and 20th
venue S.W.. The property is currently the site of the Castle Court Manufactured Home Park.
The applicant seeks to change the property's land use plan designation from the "Low Density
Residential" designation to the "Commercial" designation; and,
WHEREAS, the Planning and Zoning Commission of the City of Rochester, after
published notice and hearing, recommended the approval of the proposed amendment to the
City's "LAND USE PLAN; and
WHEREAS, the Common Council upon notice duly published held public hearings in the
Council/Board Room of the Government Center on March 17, 2003, on the matter of the
proposed amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the Applicant satisfied all of the criteria
applicable to amendments of Land Use Plans.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the "LAND USE PLAN" as adopted on March 24, 1980 and as thereafter
amended, is hereby further amended by changing the designation on the following-described
property from the "Low Density Residential" designation to the "Commercial" designation:
Lot 7, Block 2 of Highland Addition, according to the plat thereof on file in the
County Recorder's office, Olmsted County, Minnesota, except the east 66.00

feet thereof; and together with that part of the Northeast Quarter of the Northeast
• Quarter of Section 3, Township 106 North, Range 14, West , Olmsted County,
described as follows:
Commencing at the northeast corner of said Northwest Quarter; thence westerly
on an assumed azimuth from north of 269 degrees 04 minutes 50 seconds along
the north line of said Northwest Quarter 1108.80 feet to the point of beginning;
thence continue westerly 269 degrees 04 minutes 50 seconds azimuth along
said north line 198.26 feet to the northerly extension of the easterly right-of-way
line of 20th Avenue SW; thence southerly 178 degrees 37 minutes 30 seconds
azimuth along said easterly right-of-way line 329.90 feet to the north line of said
Lot 7; thence easterly 89 degrees 11 minutes 44 seconds azimuth along said
north line of Lot 7, a distance of 198.26; thence northerly 358 degrees 37
minutes 30 seconds azimuth 330.29 feet to the point of beginning.
Said tract subject to 50.00-foot easement of Second Street S.W.
Said tract contains 68,720 square feet more or less.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained
in the office of the Director of the Rochester-Olmsted Department of Planning and Housing; the
office of the Director of Public Works of the City of Rochester; and the office of the Director of
Building and Safety of the City of Rochester and shall be available for public inspection.
0 BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified
copy of this resolution in the office of the County Recorder in and for Olmsted County,
Minnesota.
