RESOLUTION
WHEREAS, Rochester Code of Ordinances (R.C.O.) section 71.07, subdivision 1
prohibits the construction of a driveway wider than 32 feet at the sidewalk line; and,
WHEREAS, R.C.O. §71.07, subd. 2 allows the Common Council of the City of Rochester
03 waive the above width restrictions upon a favorable recommendation from the Director of
Public Services if the Council determines that the wider width can safely accommodate entrance
and egress of large vehicles or heavy volumes of traffic; and,
WHEREAS, Ed Becher, the owner of the Napa Building, is requesting a 40-foot driveway
width for this building abutting 55th Street and the East Frontage Road; and,
WHEREAS, the Director of Public Works will give a favorable recommendation for a 40-
foot driveway at this location; and,
WHEREAS, the Common Council has determined that a 40-foot wide driveway can safely
accommodate entrance and egress of large vehicles or heavy volumes of traffic.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the Council finds the conditions listed at R.C.O. §71.07, subd. 2 to have been
satisfied in the case of the request of Ed Becher for the Napa Building at 551h Street and the East
Frontage Road.
BE IT FURTHER RESOLVED that the approved driveway shall not exceed 40 feet in
width.
