• RESOLUTION
WHEREAS, R.C.O. Chapter 77A provides for the creation of a Storm Water
Utility ("Utility") based on factors that influence runoff quantity and quality, including land
use and the amount of impervious surface on the property; and
WHEREAS, R.C.O. § 77A.06 provides for the establishment of a Storm Water
Utility Fee Credit Manual to provide Credits as an appropriate means of adjusting Fees
for Non-Residential property owners, thereby recognizing that effective Structural or
Non-Structural Best Management Practices can reduce the City's storm water
management burden; and
WHEREAS, R.C.O. § 77A.06 further provides Incentives as appropriate means
of recognizing efforts of Residential property owners that implement Structural or Non-
Structural Best Management Practices that reduce the City's storm water management
burden; and
WHEREAS, the City Council may, by resolution, adopt policies recommended by
the Director of Public Works or others to grant Credits or Incentives as described in a
Storm Water Utility Fee Credit Manual prepared by the Director of Public Works and
that identifies, among other things, customer eligibility criteria, the Structural and Non-
Structural Best Management Practices that qualify for application, calculation methods,
and an application form; and
WHEREAS, no public or private property shall receive Credit or Incentives for
any Structural or Non-Structural Best Management Practice unrelated to the City's cost
of providing Program services.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the City does hereby approve the adoption of the October, 2003, Storm
Water Utility Fee Credit Manual.
