RESOLUTION
WHEREAS, McGhie and Betts identified wetland on the Kingsbury Hills Fourth
Subdivision property. The wetland consists of a narrow drainageway that parallels 60th Avenue
N.W., and is a Type 2 wetland of 0.6 acres in size. The applicant proposes to fill the entire
wetland. The replacement plan for this proposed fill will be on a site within the same
subwatershed, the Ridgeview Manor development west of 50th Avenue N.W. The applicant
intends to create 52,272 square feet of new wetlands and a buffer area around the edge of the
wetland. The applicant must provide a wetland replacement area for this project of 52,272
square feet. The new wetlands and buffer are a part of a larger wetland replacement area that
combines three projects including Ridgeview Manor, West Park and Kingsbury Hills Fourth; and,
WHEREAS, the Technical Evaluation Panel met and recommended approval of the
application subject to the following conditions:
1. The applicant must monitor the wetland area and submit annual reports until the
• wetland is established, and for up to five years as required by the rules.
2. The wetland area must-be covered by a deed restriction that is in a form provided
by BWSR and recorded by the applicant.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the City approve the Wetland Replacement Plan presented by McGhie & Betts,
subject to the above conditions.
The Mayor and the City Clerk are authorized and directed to approve this plan on behalf
of the City.
