HomeMy WebLinkAboutResolution No. 594-03 RESOLUTION WHEREAS, Assisi Heights Animal Hospital applied for a Type III Conditional Use Permit (#03-51) so as to change the use of the MLS Real Estate office, a non-conforming use, to Assisi Heights Animal Hospital, a non-conforming use. The property is located in the northwest corner of 11 th Avenue N.W., and 14th Street N.W., and, WHEREAS, R.C.O. §61.146 (Standards for Conditional Use Permits) provides the relevant criteria for the review of this application; and, WHEREAS, on October 22, 2003, the Rochester Planning and Zoning Commission held a public hearing on said conditional use permit, reviewed the application according to the requirements of R.C.O. § 61.146 and recommended approval subject to the following condition: 1. Execution of a Pedestrian Facilities Agreement is required to address the Owner's obligations regarding the future construction of pedestrian facilities along the frontage of 11th Avenue NW. WHEREAS, the Common Council held a public hearing on the conditional use request on Wovember 17, 2003, and permitted all interested persons to be heard; and, WHEREAS, the Common Council determined that the applicant satisfied the conditions of R.C.O. § 61.146 by a preponderance of the evidence submitted at the public hearing subject to the above condition. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the Conditional Use Permit #03-51 to allow the change of use of the MLS Real Estate office, a non-conforming use, to Assisi Heights Animal Hospital, a non-conforming use, is granted subject to the above one condition. • 1 r PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF *ROCHESTER, MINNESOTA, THIS DAY OF /VQU(0fi1Q'�Z- 2003.
