HomeMy WebLinkAboutOrdinance No. 3958 ORDINANCE NO 3R5 AN ORDINANCE CREATING AND ENACTING SUBDIVISIONS 8, 9 AND 10 TO SECTION 125A.23 OF THE ROCHESTER CODE OF ORDINANCES, RELATING TO THE PRESENCE OF 18, 19 AND 20 YEAR OLD PERSONS UPON A LIQUOR ESTABLISHMENT AND THE NEED FOR IDENTIFICATION BY THOSE PRESENT AT A LIQUOR ESTABLISHMENT. THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN: Section 1. Subdivisions 8, 9 and 10 of Section 125A.23 of the Rochester Code of Ordinances are hereby created and enacted to read as follows: Subd. 8. No person 18, 19 or 20 years old may enter a premises licensed for the sale of intoxicating liquor except for the purpose of: A. Performing work for the premises, including the serving of intoxicating liquor, unless otherwise prohibited by Minnesota Statutes, Section 340A.412, subd. 10; B. Consuming meals; or C. Attending social functions that are held in a portion of the establishment where liquor is not sold. Subd. 9. No licensee may allow another person under the age of 21 to enter the licensed premises except as permitted by this section or section 125A.24. Subd. 10. No person shall enter or attempt to enter a premises licensed for the sale of intoxicating liquor without having in their possession a valid and unaltered driver's license, picture identification card issued by a State or United States Government or, in the case of a foreign national, a valid passport. The required form of identification must identify such person and state their date of birth. Any law enforcement officer enforcing this subdivision shall his/her discretion in determining whether the person must produce a permitted form of identification. Section 2.
