RESOLUTION
Approving Final Plat No. CD2023-016PLAT, to be known as Preserve of
Mayowood, by Mayowood Lands, LLC, for 74 residential lots and five outlots on
89.15 acres, located north of the Abigail Ln Sw and Mayowood Rd Sw
intersection.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on November 6, 2023, the following
plat of lands in Olmsted County, Minnesota are to be known and designated as follows:
That part of the Southwest Quarter of Section 9, Township 106 North, Range 14 West,
Olmsted County, Minnesota, described as follows:
Beginning at the southeast corner of said Southwest Quarter; thence North 89 degrees
43 minutes 14 seconds West, assumed bearing, along the south line thereof, 947.43
feet; thence North 00 degrees 16 minutes 46 seconds East, 100.00 feet; thence North
21 degrees 43 minutes 14 seconds West, 165.00 feet; thence North 00 degrees 16
minutes 46 seconds East, 445.00 feet; thence North 89 degrees 43 minutes 14 seconds
West, 94.65 feet; thence North 00 degrees 42 minutes 27 seconds West, 1197.58 feet;
thence South 82 degrees 05 minutes 09 seconds East, 1104.18 feet to the east line of
the Southwest Quarter of said Section 9; thence South 00 degrees 42 minutes 27
seconds East, along said east line, 1748.94 feet to the point of beginning.

Olmsted County, Minnesota, described as follows:
Commencing at the southeast corner of said Southwest Quarter, thence North 89
degrees 43 minutes 14 seconds West, assumed bearing, along the south line thereof,
947.43 feet; thence continue North 89 degrees 43 minutes 14 seconds West along said
south line, 283.47 feet to the northeasterly corner of MAYOWOOD HILLS SECOND
SUBDIVISION (the next seven courses are along the northerly line thereof); thence
North 89 degrees 43 minutes 14 seconds West, 322.11 feet; thence North 45 degrees
25 minutes 03 seconds West, 300.55 feet; thence North 48 degrees 11 minutes 14
seconds West, 169.78 feet for the point of beginning; thence North 78 degrees 38

point of beginning.
Containing 89.15 acres, more or less.
TO BE KNOWN as “Preserve of Mayowood”, Mayowood Lands, LLC, Applicant, is hereby
approved, and all dedications of land or interests in land for public purposes as shown on
said plat are hereby accepted, subject to the following conditions:
1. Prior to recordation of the Final Plat, the applicant shall amend the Final Plat exhibit
to include easements as required by RPU and Olmsted County Public Works.
2. Prior to recordation of the Final Plat, the applicant shall dedicate parkland and the
accompanying public trail access via deed.
3. Prior to recordation of the Final Plat, a conservation easement shall be recorded
to meet the conditions associated with the Shoreland Protection Permit.
4. Building permit applications located within the Special Flood Hazard Area will not
be approved until a Letter of Map Revision based on fill has been approved by
FEMA.
5. Prior to construction of the trail located within Olmsted County ROW, a ROW
permit shall be submitted and approved by Olmsted County PW.
6. Prior to construction of any public infrastructure, the applicant shall execute a City-
Owner Contract and dedicate any applicable on and off-site public easements.
