WHEREAS, pursuant to an advertisement for bids for the following improvement(s): Storm Water Pond Improvements Number 115 Orchard Ridge - Project No. J6726, the following bids were received complying with the advertisement: Fitzgerald Excavating & Trucking $451,877.85 KATS Excavating $498,291.80 Alcon Excavating Inc. $503,247.14 Griffin Construction Co., Inc. $527,994.04 Nadeau Companies $684,081.30 Pember Companies, Inc. $702,257.65 Veit & Company, Inc. $772,798.95 A-1 Excavating, Inc. $797,009.00 S.L. Contracting $799,580.85 Elcor Construction, Inc. $923,800.20 Evan Companies $943,159.96; and WHEREAS, it appears that Fitzgerald Excavating & Trucking is the lowest responsive and responsible bidder. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that the bid of $451,877.85 is hereby accepted and execution of the standard City contract for construction with Fitzgerald Excavating & Trucking is authorized for the following approved local improvements: Storm Water Pond Improvements Number 115 Orchard Ridge - Project No. J6726; and BE IT FURTHER RESOLVED that the City Clerk is directed to return to all bidders the deposits made with their bids, except the deposits of the successful bidder and the next lowest bidder, which shall be retained until the contract has been executed; and BE IT FURTHER RESOLVED that the bidder shall execute all contracts within ten days after the contract is ready for their signature, and if not executed by them in said time, they shall be deemed to have abandoned the same.
