RESOLUTION
Opposing a Request to Support a Land Use Plan Amendment Application Through Olmsted
County by WSE Massey on Behalf of the Nigon Family Farm Trust to Remove
Approximately 50 Acres from the City of Rochester’s Urban Service Area.
WHEREAS, On April 2, 2018, the Rochester City Council adopted the Planning 2 Succeed:
Rochester Comprehensive Plan 2040 (P2S 2040); and
WHEREAS, the adoption of the P2S 2040 recognized a Growth Management Strategy for the City
of Rochester by identifying which areas will potentially be affected by future edge growth; and
WHEREAS, the growth management map identifies both developed as well as fringe suburban and
agricultural areas that could accommodate urban development over the next 30 to 50 years,
predicated on the provision of services such as sanitary sewer and water systems, storm sewer
systems, upgraded transportation system, parks, and other utilities in these areas; and
WHEREAS, the Common Council of the City of Rochester by the enactment of Resolution 255-21
on November 16, 2021, duly adopted an Update to the "Growth Management Map" of the P2S 2040
Comprehensive Plan; and
WHEREAS, WSE Massey, on behalf of the Nigon Family Farm Trust, applied for a Land Use Plan
Amendment application through the Olmsted County Planning Department on July 20, 2023, to
remove approximately 50 acres from the City of Rochester’s Urban Service Area; and
WHEREAS, the Olmsted County Planning Department deemed the application incomplete as it did
not include a resolution and findings of support from the Common Council of the City of Rochester;
and
WHEREAS, WSE Massey, on behalf of the Nigon Family Farm Trust, resubmitted the Land Use
Plan Amendment application to the Olmsted County Planning Department on November 29, 2023,
to remove approximately 50 acres from the City of Rochester’s Urban Service Area; and
WHEREAS, the resubmission of the Land Use Plan Amendment application did not include a
resolution and findings of support from the Common Council of the City of Rochester; and
WHEREAS, it is requested that the Common Council of the City of Rochester make a formal
resolution and findings.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the
request for a Land Use Plan Amendment through Olmsted County is not supported for the following
described properties:
That part of the Northeast Quarter of Section 6, Township 106 North, Range 14 West, Olmsted
County, Minnesota, described as follows:
BEGINNING at the southeast corner of the Northeast Quarter of said Section 6; thence North 00
degrees 56 minutes 03 seconds East (Note: All bearings are in relationship with the Olmsted County
Coordinate System NAD ’83, Adjusted 1996), along the east line of said Northeast Quarter, 752.00
feet; thence South 83 degrees 51 minutes 34 seconds West, 248.00 feet; thence South 71 degrees
04 minutes 49 seconds West, 1650.00 feet; thence south 00 degrees 03 minutes 07 seconds East,
192.00 feet to the south line of said Northeast Quarter; thence North 89 degrees 56 minutes 53
seconds East, along said south line 1915.00 feet to the POINT OF BEGINNING.
Said parcel contains ±21.0 acres, more or less; and
That part of the Northwest Quarter of Section 5, Township 106 North, Range 14 West, Olmsted
County, Minnesota, lying west of the centerline of 45th Avenue SW and south of the following
described line:
Commencing at the southwest corner of the Northwest Quarter of said Section 5; thence North 00
degrees 56 minutes 03 seconds East (NOTE: All bearings are in relationship with the Olmsted
County Coordinate System NAD ’83, Adjust 1996), along the west line of said Northwest Quarter,
752.00 feet to the POINT OF BEGINNING of the line to be described; thence North 83 degrees 10
minutes 03 seconds East, 1763.51 feet to the centerline of 45th Avenue SW and said line there
terminating.
Said parcel contains ±30.5 acres, more or less, including the 45th Avenue SW right-of-way and the
8th Street SW right-of-way.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained in the office
of the Community Development Department of the City of Rochester and shall be available for public
inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified copy of this
resolution in the office of the County Recorder in and for Olmsted County, Minnesota.
