HomeMy WebLinkAboutOrdinance No. 4523 - Ordinance Chapt. 9-10 regulating Vending Carts ORDINANCE NO. ____ AN ORDINANCE AMENDING SUBSECTIONS (a) and (e) OF SECTION 9-10-3, AMENDING SUBSECTION (a) AND PARAGRAPH (3) OF SUBSECTION (b) OF SECTION 9-10-6, AMENDING SUBSECTION (a) OF SECTION 9-10-8 AND AMENDING SECTION 9-10-1 OF CHAPTER 9-10 OF TITLE 9 OF THE ROCHESTER CODE OF ORDINANCES RELATING TO SIDEWALK VENDING CARTS. THE COMMON COUNCIL OF THE CITY OF ROCHESTER ORDAINS: Section 1. Subsections (a) and (e) of Section 9-10-3 of Chapter 9-10 of the Rochester Code is hereby amended to read as follows: Sec. 9-10-3. Regulations. (a) A vending cart permit will be issued on a first-come, first-served basis. Notwithstanding the above provision, a person who had a food cart permit prior to April 23, 2011, shall be entitled to receive a vending cart permit, and a renewal of that permit, before others so long as that person is continuously licensed under this chapter and is in compliance with all applicable laws and ordinances. Permit applications shall be submitted in person to the office of the city clerk and shall be time stamped. Each permit issued shall expire at 12:00 midnight on December 31 of the year so issued. The permit can be transferred at any time during the permit period from one permit holder to another with the approval of the citycouncil. The permit shall be valid only when used at the permit operating location designated on the permit and is valid for one cart only. (e) A vending cart permit is valid from 7:00 a.m. to 8:00 p.m., unless otherwise provided by the citycouncil. Section 2. Subsection (a) and paragraph (3) of Subsection (b) of Section 9-10-6 of Chapter 9-10 of the Rochester Code is hereby amended to read as follows: Sec. 9-10-6. Permit procedures. (a) An application for a permit under this chapter shall be filed with the citycouncil on forms provided by the city clerk. (b) (3) A scaled diagram depicting the desired vending cart location and surrounding area in sufficient detail to determine whether or not the requirements of this chapter have been met. The citycouncil may determine the exact location where the cart may be located. Section 3. Subsection (a) of Section 9-10-8 of Chapter 9-10 of the Rochester Code is hereby amended to read as follows: Sec. 9-10-8. Permit suspension and revocation. (a) The city reserves the right to temporarily suspend or revoke revocate a vending cart permit during a Peace Plaza or other city special event, as determined by the city administrator or their designee. Section 4. Section 9-10-1 of Chapter 9-10 of the Rochester Code is hereby amended to read as follows: Sec. 9-10-1. Permit required. No person shall place a vending cart on any public sidewalk or on any public property or the Peace Plaza without first obtaining a vending cart permit from the city. common council. Section 5. This ordinance shall become effective from and after its publication.
