HomeMy WebLinkAboutOrdinance No. 4524 - Ordinance Chapt. 9-18 regulating Sidewalks, Driveway Approaches, sidewalks ORDINANCE NO. ____ AN ORDINANCE AMENDING SUBSECTION (a), PARAGRAPH (2) OF SUBSECTION (b), AND SUBSECTION (c) OF SECTION 9-18-2, AND AMENDING SECTIONS 9-18-1 AND 9-18-3 OF CHAPTER 9-18 OF TITLE 9 OF THE ROCHESTER CODE OF ORDINANCES RELATING TO CONCRETE SIDEWALKS, DRIVEWAY APPROACHES, CURBS AND GUTTERS. THE COMMON COUNCIL OF THE CITY OF ROCHESTER ORDAINS: Section 1. Subsections (a), Paragraph (2) of Subsection (b) and Subsection (c) of Section 9-18-2 of Chapter 9-18 of the Rochester Code is hereby amended to read as follows: Sec. 9-18-2. - License—Application. (a) Any person desiring to engage in the business of constructing or altering any concrete or asphalt sidewalks, driveway approaches, or curbs and gutters in the city shall apply to the citycouncil for a license to carry on said business. The citycouncil shall issue a license only if it determines that the license applicant has satisfied all of the licensing requirements found in subsection (b) of this section. (b)The licensing requirements for this chapter are as follows: (2)The license applicant must provide to the city clerk a current street address and telephone number where the applicant resides, and a street address and telephone number where the license applicant's business is physically located. A post office box address is not sufficient to satisfy this requirement. (c)The license applicant or licensee must notify the city clerk within 15 days of any change in theirits ability to comply with the licensing requirements provided in subsection (b) of this section. Section 2. Section 9-18-1 of Chapter 9-18 of the Rochester Code is hereby amended to read as follows: Sec. 9-18-1. - License—Required. No licensee persons or entities shall engage in the business of constructing or altering any concrete or asphalt sidewalks, driveway approaches, or curbs and gutters in the streets, alleys or public grounds without first being licensed under this chapter. A separate license shall be required for concrete and asphalt construction, respectively. Section 3. Section 9-18-3 of Chapter 9-18 of the Rochester Code is hereby amended to read as follows: Sec. 9-18-3. - License—Bond or insurance. No license shall be granted until the citycouncil determines that the applicant has satisfied the licensing requirements of this chapter and has filed with the city clerk a certificate of general liability and motor vehicle insurance in an amount not less than $2,000,000 each occurrence and $4,000,000 aggregate, and a $10,000 licensing bond. The licensing bond shall state that it covers defects in the work performed during the license year with the coverage to extend for a period of two years after completion of the work. No bond shall be accepted that attempts to spread the coverage of the bond amount over more than one license year. The bond shall also be conditioned to save harmless the city from any claims against it arising out of the construction by the licensee of any sidewalk or other structure whether for the city or for a private person and shall be approved as to form by the city attorney. Section 4. This ordinance shall become effective from and after its publication.
