HomeMy WebLinkAboutResolution No. 027-24 - Resolution - CD2023-002IUP Mercy Hill RESOLUTION Approving Interim Use Permit No. CD2023-002IUP, A Project To Allow For Substantial Land Alterations, Located West Of Rome Circle NW. WHEREAS, Farmland LLC has requested From the City of Rochester Major Land Subdivision approval to be known as Mercy Hill. WHEREAS, the applicant proposes to alter the landscape of the site by moving more than 100,000 cubic yards of materials and to modify the existing grade in areas by more than ten vertical feet. WHEREAS, the City Engineer has determined the land disturbing activities require an Interim Use Permit. WHEREAS, Farmland LLC has requested from the City of Rochester Interim Use Permit approval. WHEREAS, the Council adopts the Planning Commission findings as described attached to the Community Development memo dated January 10, 2024, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. M) Interim Use Permit. WHEREAS, on January 10, 2024, the City of Rochester Planning Commission reviewed the application and recommended approval. WHEREAS, on February 5, 2024, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria. BE IT FURTHER RESOLVED, that the City approve Interim Use Permit No. CD2023- 002IUP requested by Farmland LLC.
