HomeMy WebLinkAboutResolution No. 026-24 - Resolution - CD2023-021PLAT Century Village RESOLUTION Approving Major Land Subdivision No. CD2023-021PLAT, To Be Known As Century Village, A Project Consisting Of 132 Residential Lots And 3 Outlots On 17.91 Acres, Located Northeast Of The Intersection Of Silver Creek Rd NE and East Circle Dr NE. WHEREAS, Roger Payne has requested from the City of Rochester Major Land Subdivision approval to be known as Century Village. WHEREAS, the Major Land Subdivision proposes 132 residential lots and three outlots on 17.91 acres of land located northeast of the intersection of East Circle Dr NE and Silver Creek Rd NE. WHEREAS, the Council adopts the Planning Commission findings as described attached to the Community Development memo dated January 10, 2024, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit. WHEREAS, on January 10, 2024, the City of Rochester Planning Commission reviewed the application and recommended approval subject to six conditions. WHEREAS, on February 5, 2024, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application subject to six conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated six conditions of approval. BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No. CD2023-021PLAT requested by Roger Payne, subject to the conditions of approval shown below. CONDITIONS 1. Prior to submittal of the Final Plat, a Stormwater Management Plan shall be approved; 2. Prior to submittal of the Final Plat, the applicant shall identify the local residential street as “Century Village Lane NE” within the Plat Exhibit; 3. Prior to submittal of the Final Plat, all outlots shall be labeled; 4. Prior to submittal of the Final Plat, the applicant shall revise the plat exhibit to the specifications of Rochester Public Utilities; 5. Prior to recordation of the Final Plat, the applicant shall meet their boulevard tree and parkland obligation, and, 6. Each dwelling unit shall be equipped with an approved automatic sprinkler system as there is only one access to more than 50 dwelling units. Each 4-plex will require a fire alarm to monitor the fire sprinkler system and Knox key box for fire department system access.
