HomeMy WebLinkAboutResolution No. 047-24 - Resolution - Major Land Subdivision Preliminary Plat CD2023-023PLAT Oak Ridge Villas RESOLUTION Approving Major Land Subdivision No. CD2023-023PLAT, To Be Known As Oak Ridge Villas, A Project Consisting Of 6 Residential Lots On 1.25 Acres, Located At The North East Corner Of The Intersection Of 20th St SW And 3rd Ave SW. WHEREAS, Pike Design and Construction has requested from the City of Rochester Major Land Subdivision approval to be known as Century Village. WHEREAS, the Major Land Subdivision proposes 6 residential lots on 1.25 acres of land located north east corner of the intersection of 20th St. SW and 3rd Ave.SW. WHEREAS, the Council adopts the Planning Commission findings as described attached to the Community Development City Council memo dated March 18, 2024, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit. WHEREAS, on February 14, 2024, the City of Rochester Planning Commission reviewed the application and recommended approval subject to seven conditions. WHEREAS, on March 4, 2024, the City of Rochester Common Council opened a public hearing, which was continued and reopened March 18, 2024, to consider this application and adopted the findings of fact and approved the application subject to seven conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated seven conditions of approval. BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No. CD2023-023PLAT requested by Pike Design and Construction, subject to the conditions of approval shown below. CONDITIONS 1. Prior to the submittal of the Final Plat, a Stormwater Management Plan and Civil Plan Set meeting the adopted City of Rochester Engineering Standards shall be approved by Public Works. 2. Prior to submittal of the Final Plat, the applicant shall revise the construction plans to the satisfaction of RPU Water. 3. Prior to recordation of the Final Plat, the applicant shall meet their boulevard tree and parkland obligation. 4. Prior to recordation of the Final Plat, execution of a City prepared Contribution Agreement is required. Said agreement will memorialize terms and conditions related to future 3rd Avenue SW and 20th Street SW obligations, and obligations for future pedestrian facilities along said frontage. 5. Prior to recordation of the Final Plat, a cross access agreement / easement, and a shared maintenance agreement and private utility easement is required for access and for the shared utility services serving the six lots in the development. 6. The existing drive approaches abutting 20th Street SW and the drive approach / excess bituminous abutting 3rd Avenue SW, shall be removed and the boulevard and the turf reestablished concurrent with development. 7. The developer shall construct a six-foot tall sight obscuring privacy fence along the east property line, from a point 20 feet north of the southeast property corner to the northeast property corner of lot the east most lot.
