HomeMy WebLinkAboutResolution No. 061-24 - Resolution - Establishing Sidewalk Improvement District SW-5 and Rates to be Collected from 2025 to 2029 RESOLUTION Awarding Contract for 2024 Sidewalk and Pedestrian Ramp Improvements SW District 5-1 - Project No. J4727, establishing Sidewalk Improvement District SW-5, and establishing rates to be collected from 2025 to 2029. WHEREAS, The City Council adopted the Sidewalk Improvement District Program for the annual repair and replacement of City sidewalks on November 14, 2022; and WHEREAS, pursuant to an advertisement for bids for the following improvement(s): 2024 Sidewalk and Pedestrian Ramp Improvements SW District 5-1 - Project No. J4727, the following bids were received complying with the advertisement: Ti-Zack Concrete, LLC $2,079,441.41 Pember Companies, Inc $3,684,867.95; and WHEREAS, it appears that Ti-Zack Concrete, Inc. is the lowest responsive and responsible bidder; and WHEREAS, implementation of the program requires establishment of the Districts contributing to annual repair and replacement of City sidewalks; and WHEREAS, implementation of the program also requires establishment of the Project Areas within Districts where annual repair and replacement of City sidewalks will be focused; and WHEREAS, implementation of the program also requires establishment of the rates assessed to parcels within each District. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester that the bid of $2,079,441.41 is hereby accepted and execution of the standard City contract for construction with Ti-Zack Concrete, Inc., is authorized for the following approved local improvements: 2024 Sidewalk and Pedestrian Ramp Improvements SW District 5-1 - Project No. J4727; and BE IT FURTHER RESOLVED that the City Clerk is directed to return to all bidders the deposits made with their bids, except the deposits of the successful bidder and the next lowest bidder, which shall be retained until the contract has been executed; and BE IT FURTHER RESOLVED that the bidder shall execute all contracts within ten days after the contract is ready for their signature, and if not executed by them in said time, they shall be deemed to have abandoned the same; and BE IT FURTHER RESOLVED that Sidewalk Improvement District SW-5, shown in the attached figure and generally described as: Parcels within City limits starting at Hwy 52 NW and Civic Hwy 14 NW interchange, going south on Hwy 52 until 3 ST SW, then east to the back property line of PIN 48817 then to the south property line, then east to the Destination Medical Center (DMC) boundary and follow the DMC boundary to Broadway Ave S and 12 ST SW/SE, continuing south on Broadway Ave S/Hwy 63 S to Rochester International Airport, the following the City limits boundary to Country Club Rd W and 45 Ave NW/SW, then east on Country Club Rd W to W Circle Dr NW and northeast back to Hwy 52 NW and Hwy 14 NW. is established for sidewalk replacements and repairs to be completed in 2024 and assessed to participating parcels in the District from 2025 to 2029. BE IT FURTHER RESOLVED that Project Area SW 5-1, shown in the attached figure and generally described as: Parcels within City limits starting at 6 ST SW and 12 Ave SW following 6 ST SW west to Hwy 52 then south to the south property lines of Folwell Heights 3rd, west to 23 Ave SW, then following 23 Ave SW south to Fox Knoll Dr SW, south to Fox Valley Dr SW, then west on Fox Valley Dr SW to W Circle Dr SW, following the City limits north and west to Country Club Rd W and 45 Ave SW, then east on Country Club Rd W to W Circle Dr NW, then northeast to Hwy 14 and Hwy 52, then south on Hwy 52 to the Destination Medical Center (DMC) boundary then following the DMC boundary south to NW corner of 2 ST SW and W Frontage Rd, crossing 2 ST SW and following the DMC boundary from the SW corner of 2 ST SW and W Frontage road back to 6 ST SW and 12 Ave SW. Parcels within area 6 ST SW and 5 Ave SW, north on 5 Ave SW to 4 ST SW, west on 4 ST SW to 6 Ave SW, north on 6 Ave SW to 3 ST SW, west on 3 ST SW to 9 Ave SW, south on 9 Ave SW to 4 ST SW, west on 4 ST SW to 10 Ave SW, south on 10 Ave SW to 6 ST SW then east back to 6 ST SW and 5 Ave SW. is established as the project area for sidewalk replacements and repairs for the 2024 construction season.
