RESOLUTION
Authorizing Acceptance of a Grant from the Minnesota Department of Employment
and Economic Development (DEED) in the amount of $14,000,000 for the
Acquisition of Property and the Predesign, Design, Site Preparation, and all Related
Construction Activities for the Relocation of City of Rochester Parks & Forestry
Operations to the Public Works & Transit Operations Center (PWTOC) - Project No.
3069.
WHEREAS, the following clauses are put forward for adoption by the State of Minnesota’s
Department of Employment and Economic Development (DEED) and are required to be
adopting by the Common Council and submitted with the City of Rochester’s Special
Appropriation Application for Construction Projects packet; therefore
BE IT RESOLVED that the City of Rochester shall act as the legal sponsor for the project
contained in Chapter 71, Article No. 670, Section 14, Subdivision 34, entitled Rochester
Parks and Forestry Operations Center Relocation; and
BE IT FURTHER RESOLVED that the City of Rochester has the legal authority to receive
financial assistance, and the institutional, managerial, and financial capability to ensure
adequate project administration; and
BE IT FURTHER RESOLVED that the sources and amounts of the local match identified
in the development proposal are committed to the project identified; and
BE IT FURTHER RESOLVED that the City of Rochester (Entity Awarded Grant) has not
violated any Federal, State, or local laws pertaining to fraud, bribery, graft, kickbacks,
collusion, conflict of interest or other unlawful or corrupt practice; and
BE IT FURTHER RESOLVED that upon approval of its development proposal by the
State of Minnesota, the City of Rochester may enter into an agreement with the State of
Minnesota for the above-referenced project(s), and that the City of Rochester certifies
that it will comply with all applicable laws and regulation as stated in all contract
agreements; and
BE IT FURTHER RESOLVED that the non-DEED source(s) of funds identified in the
sources and uses outline in the application total the amount of $29,000,000, are
committed and adequate to fully fund or provide the match for the project identified in the
application; and
BE IT FURTHER RESOLVED that any source(s) of the Applicant’s funds to fully fund the
project shall be from the Capital Improvement Fund account which has an adequate
amount of funds to cover the commitment; and
BE IT FURTHER RESOLVED that the Mayor and the City Clerk are authorized by the
Home Rule Charter of the City of Rochester, Section 4.01. – (Execution of documents).
to execute all agreements necessary to implement the project(s) related to this grant on
behalf of the City of Rochester.
NOW, THEREFORE BE IT RESOLVED, that the Common Council of the City of
Rochester, Minnesota, that the Council hereby accepts this grant and authorizes the
execution of the aforementioned terms and all corresponding agreements relating to the
Relocation of City of Rochester Parks & Forestry Operations to the Public Works & Transit
Operations Center (PWTOC) - Project No. 3069.
