HomeMy WebLinkAboutResolution No. 100-24 - Resolution - CD2024-003PLAT Scenic Oaks West Third RESOLUTION Approving Major Land Subdivision No. CD2024-003PLAT, To Be Known As Scenic Oak West Third, A Project Consisting Of 95 Residential Lots And Five Outlots On 60 Acres, Located South Of The Scenic Drive SW And Scenic Point Drive SW Intersection. WHEREAS, YH Dee LLC and Hanson & Younge LLC have requested from the City of Rochester approval of a Major Land Subdivision to be known as Scenic Oaks West Third. WHEREAS, the Major Land Subdivision proposes 95 residential lots and five outlots on 60 acres of land located south of the Scenic Drive SW and Scenic Point Drive SW intersection. WHEREAS, the Council adopts the Planning Commission findings as described in the attached Community Development memo dated April 24, 2024, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit. WHEREAS, on April 24, 2024, the City of Rochester Planning Commission reviewed the application and recommended approval subject to six conditions. WHEREAS, on May 20, 2024, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application subject to six conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated six conditions of approval. BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No. CD2024-003PLAT requested by YH Dee LLC and Hanson & Younge LLC, subject to the conditions of approval shown below. CONDITIONS 1. Prior to the submittal of the Final Plat, all outlots shall be labeled on the Plat Exhibit. 2. Prior to the submittal of the Final Plat, a Stormwater Management Plan shall be approved. 3. Prior to the submittal of the Final Plat, RPU Water comments in the memo dated April 8, 2024, shall be addressed. 4. Prior to the submittal of the Final Plat, Rochester Fire Department comments in the memo dated April 1, 2024, shall be addressed. 5. Prior to the submittal of the Final Plat, the applicant shall pay applicable Final plat GIS Impact and E911 Addressing fees. 6. Prior to the recordation of the Final plat, the applicant shall meet their boulevard tree obligation.
