HomeMy WebLinkAboutResolution No. 099-24 - Resolution - Driveway Easement & Agreement for 510 10th Ave SE RESOLUTION Authorizing Execution of a Driveway Easement & Agreement for the Property Located at 10th Ave SE. WHEREAS, the property owner of 501 10th Ave SE has been accessing their garage via a driveway that is located on property owned by the City since at least 1975; and WHEREAS it was recently discovered that the property owners have been using and maintaining this driveway without an easement from the City, or other recorded document providing access rights; and WHEREAS, approving the driveway easement ensures that the property owners can continue to maintain and use the existing driveway while the City is better protected by enumerating and limiting what the property owners are permitted to use the easement area for. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the Council authorizes execution of a Driveway Easement & Agreement with Ashley Andrist, for a perpetual and non-exclusive driveway easement for property located at 501 10th Ave SE.
