RESOLUTION
Approving Comprehensive Plan Amendment No. CD2024-001CPA, To Amend the
Land Use Map on A 9.48 Acre Site on the West Side of East River Road, Immediately
North of the 44th St. NE Alignment., From Low Density Residential to Industrial.
WHEREAS, the Common Council of the City of Rochester, by enactment of Resolution 147-
18 on April 16, 2018, duly adopted a "LAND USE PLAN" as part of the P2S Comprehensive
Plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, the Property Owner, Rochester Sand and Gravel, initiated an amendment to
the Land Use Plan to change the land use designation on approximately 9.48 acres, located
th
on the west side of East River Road, immediately north of the 44 St. NE Alignment, from
“Low Density Residential” to “Industrial;” and
WHEREAS, the Community Development Department recommended the approval of the
proposed amendment to the City’s “LAND USE PLAN;” and,
WHEREAS, on May 8, 2024, the City of Rochester Planning and Zoning Commission, after
published notice and public hearing, recommended approval of the proposed amendment
to the City's "LAND USE PLAN;" and
WHEREAS, on June 3, 2024, after published notice, the Common Council, held a public
hearing on the matter of the proposed amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the application did satisfy all of the criteria
applicable to amendments of Land Use Plans based upon the findings of fact proposed by
the Community Development Team.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that the "LAND USE PLAN" as adopted on April 16, 2018, and as thereafter amended, is
hereby further amended by changing the designation on 9.48 acres of property, per the
“Exhibit Map” for Application No. CD2024-001CPA, from “Low Density Residential”
designation to the “Industrial” designation:
BE IT FURTHER RESOLVED that a certified copy of this Resolution shall be maintained in
the office of the Community Development Department of the City of Rochester and shall be
available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified copy
of this resolution in the office of the County Recorder in and for Olmsted County, Minnesota.
