HomeMy WebLinkAboutResolution No. 119-24 - Resolution - Major Land Subdivision Preliminary Plat No. CD2024-005PLAT Norsq RESOLUTION Approving Major Land Subdivision No. CD2024-005PLAT, to be known as Norsq, Located at the Northeast Corner of the Intersection of 41st St NW and Arboretum Dr NW. WHEREAS, Norsq Companies has requested from the City of Rochester Major Land Subdivision approval to be known as Norsq. WHEREAS, the Major Land Subdivision proposes 2 blocks on 18.54 acres of land located at the northeast corner of the intersection of 41st St. NW and Arboretum Dr NW. WHEREAS, the Council adopts the Planning Commission findings as described attached to the Community Development City Council memo dated May 22, 2024, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit. WHEREAS, on May 22, 2024, the City of Rochester Planning Commission reviewed the application and recommended approval, subject to seven conditions. WHEREAS, on June 17, 2024, the City of Rochester Common Council opened a public hearing, adopted the findings of fact, and approved the application subject to seven conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated seven conditions of approval. BE IT FURTHER RESOLVED that the City approve Major Land Subdivision No. CD2024- 005PLAT requested by Norsq Companies, subject to the conditions of approval shown below: CONDITIONS 1. Prior to submission of a Final Plat, Civil Plans & Stormwater Management Plans shall be submitted and approved by Rochester Public Works. 2. Prior to submission of a Final Plat, the submitted Traffic Impact Report currently in process shall be accepted by the Public Works Department, or a Traffic Impact Report waiver issued by Public Works is required. 3. Prior to recordation of the Final Plat, the applicant shall submit a Utility Easement Vacation Application to eliminate existing easements that are in conflict with proposed improvement and construction plans. 4. Prior to recordation of the Final Plat, Public Utility Easements shall be dedicated to the satisfaction of RPU-Electric and RPU-Water. 5. Prior to recordation of the Final Plat, the applicant shall satisfy the Parkland Dedication Requirement. 6. Prior to recordation of the Final Plat, the Execution of a City prepared Site Development Agreement shall be recorded and memorialized. 7. Final improvement plans shall conform to standard City of Rochester requirements, final improvement plans shall be updated in accordance with RPU Water redline comments provided on the preliminary plat application.
