HomeMy WebLinkAboutResolution No. 118-24 - Resolution - CD2024-006PLAT Morris Landings Villas RESOLUTION Approving Major Land Subdivision No. CD2024-006PLAT, to be known As Morris Landings Villas, Located North Of The Terminus Of 16th AveNE and West Of Stone Crest Drive NE. WHEREAS, River Bend Development LLC has requested from the City of Rochester approval of a Major Land Subdivision to be known as Morris Landings Villas. WHEREAS, this Major Land Subdivision proposes 25 residential lots and one outlot on 10 acres of land located north of the terminus of 16th Ave NE and west of Stone Crest Drive NE. WHEREAS, the Council adopts the Planning Commission findings as described in the attached Community Development memo dated May 22, 2024, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit. WHEREAS, on May 22, 2024, the City of Rochester Planning Commission reviewed the application and recommended approval subject to six conditions. WHEREAS, on June 17, 2024, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application subject to six conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated six conditions of approval. BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No. CD2024-006PLAT requested by River Bend Development LLC, subject to the conditions of approval shown below. CONDITIONS 1. Prior to the submittal of the Final Plat application, Final Plat GIS Impact and E911 Addressing fees must be paid. 2. Prior to the submittal of the Final Plat application, an agreement memorializing the location of the dedicated parkland between Farmland LLC and Meier Companies must be provided to the Rochester Community Development and Parks and Recreation Departments. 3. Prior to the submittal of the Final Plat application, the Civil Plans and Stormwater Management Plan must be approved by the Rochester Public Works Department. 4. Prior to the submittal of the Final Plat application, a Decorah Edge Study must be completed and approved by the Local Government Unit (LGU). 5. Prior to the submittal of the Final Plat application, a supplemental Development Agreement must be executed to address the issues as outlined in the Rochester Public Works memo dated May 5, 2024. 6. Prior to the submittal of the Final Plat application, the developer must secure the easement rights for the proposed 30-foot-wide public drainage and utility easement as depicted on the plat exhibit.
