HomeMy WebLinkAboutResolution No. 139-24 - Resolution - CD2024-016PLAT - Norsq Rochester Final Plat RESOLUTION Approving Final Plat No. CD2024-016PLAT, To Be Known As Norsq Rochester, A Project Consisting of 2 Blocks on 18.54 acres, Located At The Northeast Corner of the Intersection of 41st St. NW and Arboretum Dr. NW WHEREAS, Norsq Companies has requested from the City of Rochester Final Plat approval to be known as Norsq Rochester. WHEREAS, the Final Plat proposes 2 blocks on 18.54 acres of land located at the st northeast corner of intersection of Arboretum Dr. NW and 41 St. NW. WHEREAS, the Council adopts the findings as described attached to the Community Development memo dated July 15, 2024, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. H) Final Plat. WHEREAS, on May 22, 2024, the City of Rochester Planning Commission reviewed the Major Land Subdivision application and recommended approval subject to eight conditions. WHEREAS, on June 17, 2024, the City of Rochester Common Council held a public hearing to consider a Major Land Subdivision application and adopted the findings of fact and approved the application subject to seven conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, a public hearing duly noticed and held on July 15, 2024, the following plat of lands in Olmsted County, Minnesota are to be known and designated as follows: That part of the Southwest Quarter of Section 16 and that part of the Southeast Quarter of Section17, all in Township 107 North, Range 14 West, Olmsted County, Minnesota, described as follows: Beginning at the southeast corner of Lot 26, Block 1, LINCOLNSHIRE EIGHTH SUBDIVISION, according to the plat thereof on file at the County Recorder's office, Olmsted County, Minnesota; thence South 89 degrees 28 minutes 08 seconds East, assumed bearing along the south line of said LINCOLNSHIRE EIGHTH SUBDIVISION, a distance of 229.08 feet to the southwest corner of LINCOLNSHIRE SIXTH SUBDIVISION, according to the plat thereof on file at said County Recorder's office; thence North 88 degrees 59 minutes 05 seconds East along the south line of said LINCOLNSHIRE SIXTH SUBDIVISION, a distance of 653.66 feet; thence South 01 degree 02 minutes 06 seconds East, a distance of 450.30 feet to the south line of said Southwest Quarter of Section 16; thence South 88 degrees 58 minutes 06 seconds West along said south line, a distance of 1339.60 feet to the southeast corner of the Southeast Quarter of said Section 17; thence South 88 degrees 05 minutes 13 seconds West along the south line of said Southeast Quarter, a distance of 257.77 feet to the easterly right-of-way line of Douglas Trail; thence North 04 degrees 52 minutes 16 seconds West along said easterly right-of-way line, a distance of 324.90 feet to the south line of Block 1 of LINCOLNSHIRE SEVENTH SUBDIVISION, according to the plat thereof on file at the County Recorder's Office, Olmsted County, Minnesota; thence North 88 degrees 58 minutes 04 seconds East along said south line and said south line of Block 1 of LINCOLNSHIRE EIGHTH SUBDIVISION, a distance of 616.38 feet to the southeast corner of Lot 11, said Block 1, LINCOLNSHIRE EIGHTH SUBDIVISION; thence North 01 degree 00 minutes 55 seconds West, along the east line of said Block 1, a distance of 139.80 feet to said south line of Lot 26 of said Block 1; thence South 89 degrees 28 minutes 08 seconds East along said south line, a distance of 120.04 feet to said southeast corner of Lot 26, Block 1 and the point of beginning. TOGETHER WITH: Lot 1, Block 2, TRAILRIDGE AT 41ST BY IRET, according to the plat thereof on file at the County Recorder's office, Olmsted County, Minnesota. TO BE KNOWN as “Norsq Rochester”, by Norsq Companies, Applicant, is hereby approved, and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the follow conditions: 1. Prior to recordation of the Final Plat, the County Surveyor’s Acknowledgement signature block shall be updated to identify “Olmsted” County rather than “Hennepin” County. 2. Prior to recordation of the Final Plat, Civil Engineering Plans & Stormwater Management Plans shall be updated and approved in accordance with Rochester Public Works review comments. 3. Prior to recordation of the Final Plat, Civil Engineering Plans shall be updated and approved in accordance with RPU Water and RPU Electric review comments. 4. Prior to Final Plat Recordation, the plat shall be revised in accordance with the following RPU Water review comments:  All utility easements solely for public water main infrastructure needs to be relabeled to “water main utility easements”.  Water main utility easements need to be coordinated with and match the approved proposed water main layouts and fire hydrant locations. 5. Prior to recordation of the Final Plat, a Utility Easement Vacation Application to eliminate existing easements that are in conflict with proposed project improvements and construction plans shall be approved. 6. Prior to project construction, a City-Owner Contract shall be executed, dedication of any applicable on and off-site public easements shall be required prior to construction of any public infrastructure for each phase of this development. 7. The applicant shall provide the easement legal descriptions and drawing exhibits to RPU Electric, after electric, communication, and gas systems are designed for the project for RPU to incorporate such documention into the standard City of Rochester public utility easement template, which is to be recorded by the applicant with Olmsted County. Alternately, the developer may provide RPU and MERC with the CAD file for review as to establish dry utility easements for the project that would be represented on a revised final plat. 8. Prior to recordation of the Final Plat, the applicant shall satisfy the Parkland Dedication Requirement.
