RESOLUTION
Approving Final Plat No. CD2024-020PLAT, To Be Known As Century Village, A
Subdivision Consisting of 72 Residential Lots, Two Common Area Lots, and Two
Outlots on 17.91 acres, Located At The Northeast Corner of East Circle Dr. NE and
Silver Creek Rd. NE.
WHEREAS, Robert Fleming has requested from the City of Rochester Final Plat approval
for a subdivision to be known as Century Village.
WHEREAS, the Final Plat proposes 72 residential Lots, two common area lots, and two
outlots 17.91 acres of land located at the northeast corner of East Circle Dr. NE and Silver
Creek Rd. NE.
WHEREAS, the Council adopts the findings as described attached to the Community
Development memo dated August 19, 2024, and finds the proposal meets the criteria in
R.C.O § 60.500.040 (subd. H) Final Plat.
WHEREAS, on January 10, 2024, the City of Rochester Planning Commission reviewed
a Major Land Subdivision for the development and recommended approval subject to six
conditions.
WHEREAS, on February 5, 2024, the City of Rochester Common Council held a public
hearing to consider the Major Land Subdivision for the development, adopted the findings
of fact, and approved the Major Land Subdivision subject to six conditions.
WHEREAS, on August 19, 2024, the City of Rochester Common Council held a public
hearing to consider a Final Plat application for the development, adopted the findings of
fact, and approved the Final Plat subject to three conditions.
NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester,
at a public hearing duly noticed and held on August 19, 2024, the following plat of lands in
Olmsted County, Minnesota is to be known and designated as follows:
The South 825 feet of the Northwest Quarter of the Northeast Quarter of Section 31,
Township 107 North, Range 13 West, Olmsted County, Minnesota, lying east of County
State Aid Highway No. 22, and that part of the Northeast Quarter of the Northeast Quarter
of said Section 31, described as follows:
Commencing at the northeast corner of said Northeast Quarter; thence on an assumed
bearing of South 00 degrees 01 minute 19 seconds West, along the east line of said
Northeast Quarter 1305.94 feet to the southeast corner of said Northeast Quarter of the
Northeast Quarter; thence North 89 degrees 38 minutes 11 second West along the south
line of said Northeast Quarter of the Northeast Quarter 506.78 feet to the southwest corner
of Outlot B, CENTURY VALLEY, according to the plat thereof, on file and of record in the
Office of the County Recorder, Olmsted County, Minnesota, and point of beginning; thence
North 07 degrees 56 minutes 26 seconds East, along the westerly line of said Outlot B,
187.81 feet; thence North 34 degrees 07 minutes 13 seconds East, along said westerly line,
550.87 feet to the southwesterly line of Block 2, CENTURY HILLS TENTH SUBDIVISION,
according to the plat thereof, on file and of record in the Office of the said County Recorder;
thence North 55 degrees 07 minutes 39 seconds West, along said southwesterly line,
228.94 feet; thence North 87 degrees 46 minutes 34 seconds West, along the southerly
lines of CENTURY HILLS TENTH SUBDIVISION and CENTURY HILLS NINTH
SUBDIVISION, according to the respective plats thereof, on file and of record in the Office
of the said County Recorder, 529.96 feet to the southwest corner of Block 1 in said
CENTURY HILLS NINTH SUBDIVISION; thence North 18 degrees 26 minutes 39 seconds
West, along the westerly line of said Block 1, a distance of 83.98 feet to its intersection with
the east line of the west 400.00 feet of the Northeast Quarter of the Northeast Quarter of
said Section 31; thence South 00 degrees 01 minutes 51 seconds West, along said easterly
line, 160.88 feet to the southerly line of that certain parcel described by metes and bounds,
depicted on Certificate of Survey incorporated within a Warranty Deed, dated October 28,
2018, recorded November 06, 2018 as Document Number A-1461243; thence North 89
degrees 58 minutes 09 seconds West, along said southerly line 400.00 feet to the west line
of said Northeast Quarter of the Northeast Quarter; thence North 00 degrees 01 minute 51
seconds East, along said west line, 117.63 feet to the north line of said South 825 feet of
the Northwest Quarter of the Northeast Quarter, said line also being the south line of
CENTURY POINT SUBDIVISION, according to the plat thereof, on file and of record in the
Office of the said County Recorder; thence North 89 degrees 38 minutes 11 seconds, along
said line, 254.40 feet to the easterly right of way line of C.S.A.H. No. 22, according to
OLMSTED COUNTY HIGHWAY RIGHT OF WAY PLAT No. 47; thence South 18 degrees
56 minutes 17 seconds East, along said easterly right of way line, 136.44 feet; thence South
21 degrees 53 minutes 22 seconds East, along said easterly right of way line, 663.09 feet;
thence South 89 degrees 38 minutes 07 seconds East, along said easterly right of way line,
179.32 feet; thence South 73 degrees 50 minutes 05 seconds East, along said easterly right
of way line, 303.04 feet to the south line of said Northeast Quarter of the Northeast Quarter;
thence South 89 degrees 38 minutes 11 seconds East, along said south line 301.57 feet to
the point of beginning

Said tract containing 17.80 acres, more or less.
TO BE KNOWN as “Century Village”, by Robert Fleming, Applicant, is herby approved,
and all dedications of land or interests in land for public purposes as shown on said plat
are hereby accepted, subject to the follow conditions:
1. Prior to the recordation of Final Plat mylars, the Civil Improvement Construction
Plans shall be approved and executed by Public Works and Rochester Public
Utilities.
2. Prior to recordation of Final Plat mylars, the applicant shall provide documentation
that GIS impact and E911 addressing fees have been paid to Olmsted County.
3. Prior to construction of any public infrastructure, the execution of a City-Owner
Contract and dedication of any applicable on and off-site public easements is
required. Development charges/fees applicable to the development of this
Property will be addressed in City-Owner Contract and/or Development
Agreements.
