RESOLUTION
Approving Major Land Subdivision No. CD2024-022PLAT, To Be Known As Prairie
Ridge, A Project Consisting Of 51 Single Family Residential Lots, 250 Townhome
Lots and 3 Parcels for Future Multi-family Development On 75.04 Acres, Located
At The Southwest Corner of the Intersection of Valleyhigh Rd NW and 50th Ave,
NW.
WHEREAS, West 80 Partners, LLC has requested from the City of Rochester Major Land
Subdivision approval to be known as Prairie Ridge; and
WHEREAS, the Major Land Subdivision proposes 51 single family lots, 250 townhome
lots, and 3 parcels for future multi-family development on 75.04 acres of land located at
southwest corner of the intersection of Valleyhigh Rd NW and 50th Ave NW; and
WHEREAS, the Council adopts the Planning Commission findings as described attached
to the Community Development City Council memo dated September 25, 2024, and finds
the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision
Permit; and
WHEREAS, on September 25, 2024, the City of Rochester Planning Commission
reviewed the application and recommended approval, subject to seven conditions; and
WHEREAS, on October 21, 2024, the City of Rochester Common Council opened a
public hearing, and approved the application subject to seven conditions.
NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester
that, based upon the above-stated findings of fact, the Applicant has shown by a
preponderance of the evidence submitted at the public hearing that it has satisfied the above
criteria subject to the imposition of the below-stated seven conditions of approval.
BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No.
CD2024-022PLAT requested by West 80 Partners, LLC., subject to the conditions of
approval shown below:
CONDITIONS
1. Prior to the submission of a final plat, the applicant shall provide an updated Major
Land Subdivision exhibit addressing additional required public utility easements as
directed by Rochester Public Utilities (“RPU”).
2. Prior to the submission of a final plat, the applicant shall provide finalized
documentation and approval of the No-Loss application by the Local Governmental
Unit.
3. Prior to the submission of any final plat for single-family or townhome development,
Parkland Dedication, with cash in lieu of property dedication, shall be provided to
the Rochester Parks and Recreation Department. Multi-family development is also
subject to Parkland Dedication Ordinance, fee in-lieu of property dedication shall
be provided to the Parks and Recreation Department, prior to Site Development
Plan application approval for multi-family development.
4. Prior to the submission of a final plat, Civil Improvement Construction Plans shall
be approved and executed by both Public Works and RPU.
5. Prior to submission of a final plat, the applicant shall address all comments
provided by RPU Water & RPU Electric on the Civil Improvement Construction
Plan set to the satisfaction of RPU.
6. There are presently inadequate on and off-site public facilities in place to
accommodate the development of this property. No development will be allowed
to occur until the City Council has concluded all required public facilities have been
established and adequate for said development. In-lieu of waiting for the
completion of all needed public facilities to be in place, the Owner may request the
City prepare a Development Agreement for Owner’s execution to memorialize
terms and obligations specific to development of this property, prior to final plat
approval.
7. Prior to construction of any public infrastructure, the execution of a City-Owner
Contract and dedication of any applicable on and off-site public easements is
required. Development charges/fees applicable to the development of this
Property will be addressed in the City-Owner Contract and/or Development
Agreements.
