HomeMy WebLinkAboutResolution No. 224-24 - Resolution - CD2024-026PLAT Hadley Creek 5th RESOLUTION Approving Major Land Subdivision No. CD2024-026PLAT, To Be Known As Hadley Creek 5th, A Project Consisting Of 57 Residential Lots And One Outlot On 17.5 Acres, Located at the terminus of both Hadley Creek Dr NE and Hadley Hills Dr NE. WHEREAS, Farmland LLC have requested from the City of Rochester the approval of a Major Land Subdivision to be known as Hadley Creek 5th. WHEREAS, the Major Land Subdivision proposes 57 residential lots and one outlot on 17.5 acres of land located at the terminus of both Hadley Creek Dr NE and Hadley Hills Dr NE. WHEREAS, the Council adopts the Planning Commission findings as described in the attached Community Development memo dated October 9, 2024, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit. WHEREAS, on October 9, 2024, the City of Rochester Planning Commission reviewed the application and recommended approval subject to nine conditions. WHEREAS, on November 4, 2024, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application subject to nine conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated nine conditions of approval. BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No. CD2024-026PLAT requested by Farmland LLC, subject to the conditions of approval shown below. CONDITIONS 1. Prior to Final Plat submittal, a Floodplain Development Permit must be approved by Rochester Community Development. 2. Prior to Final Plat submittal, the applicant shall provide Community Development with an updated Shoreland Exhibit detailing the impervious surface calculations for lots 1-4, 6-7, and 16-31 of Block 4. 3. Prior to Final Plat Submittal, the applicant shall designate Lot 1, Block 1 as an outlot. 4. Prior to Final Plat submittal, a Stormwater Management, Civil, and Grading Plans shall be approved. 5. Prior to Final Plat submittal, RPU Electric comments shall be addressed. 6. Prior to Final Plat submittal, RPU Water comments shall be addressed. 7. Prior to Final Plat submittal, Rochester Fire Department comments shall be addressed. 8. Prior to Final Plat recording, the applicant shall meet their parkland dedication obligation. 9. Prior to Final Plat recording, the applicant shall meet their boulevard tree obligation. 10. Prior to the beginning of grading, temporary bridge construction will be substantially completed.
