HomeMy WebLinkAboutResolution No. 235-24 - Resolution Silver Lake Dam Modification Grant Agreement - J4889 RESOLUTION Authorizing Execution of a Grant Agreement with the State of Minnesota, acting through its Commissioner of Natural Resources, in the amount of $2,368,000 for the Silver Lake Dam Fish Passage Modification Project. WHEREAS, Under Minnesota Statute §84.026, the Department of Natural Resources (“DNR”) is empowered to enter into grant agreements on behalf of the State of Minnesota (“State”); and WHEREAS, Under Minnesota Laws 2024, Chapter 106, Article 1, Section 2, Subd. 5(x), Silver Lake Dam Fish Passage Modification, the State allocated $2,368,000 via the DNR to the City of Rochester (“City”) as a grant to restore and enhance aquatic habitat in Silver Lake and the south fork of the Zumbro River by modifying the existing low-head dam in Rochester; and WHEREAS, the City has the legal authority to enter into said agreement with the DNR pursuant to Minnesota Statute Chapter 412.211. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester that: 1. The City of Rochester’s Home Rule Charter authorizes the Mayor and City Clerk to execute the Grant Contract Agreement with the State to enable receipt of award funding; and 2. The City agrees to cover any costs that exceed the amount of funds provided by the State of Minnesota as necessary to complete the project.
