HomeMy WebLinkAboutOrdinance No. 4553 - Ordinance: Zone Change City View Flats CD024-002ZC ORDINANCE NO. ______ ORDINANCE REZONING APPROXIMATELY 10 ACRES OF LAND LOCATED ON THE SOUTH SIDE OF COLLEGEVIEW ROAD EAST, APPROXIMATELY 1,300 FEET EAST OF THE COLLEGEVIEW ROAD SOUTHEAST INTERSECTION WITH EAST CIRCLE DRIVE SE FROM R-2 (LOW DENSITY RESIDENTIAL- SMALL LOT) TO R-3 (MEDIUM DENSITY RESIDENTIAL) AND AMENDING ORDINANCE NO. 4478, KNOWN AS THE UNIFIED DEVELOPMENT CODE OF THE CITY OF ROCHESTER, MINNESOTA. THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN: Section 1. Upon public hearing duly noticed and held, Ordinance No. 4478 as amended, known as the Unified Development Code of the City of Rochester, Minnesota, is hereby further amended as follows: The Zoning Map of the City of Rochester as adopted by said Ordinance No. 4478 establishing the various zoning districts and boundaries thereof is amended by rezoning the following described lands to the district indicated: R-3 A parcel of land lying within the following described property: That part of the Northeast Quarter of the Northwest Quarter of Section 5, Township 106 North, Range 13 West, Olmsted County, Minnesota, lying North of the plat of Stonebridge, except the North 208.71 feet of the East 208.71 feet of said Northeast Quarter of the Northwest Quarter of said Section 5, Township 106 North, Range 13 West, Olmsted County. And The North 208.71 feet of the East 208.71 feet of the Northeast Quarter of the Northwest Quarter of Section 5, Township 106 North, Range 13 West, Olmsted County. Said parcel is more particularly described as follows: Commencing at the northeast corner of said Northeast Quarter of the Northwest Quarter; thence South 00 degrees 43 minutes 59 seconds East, assumed bearing, along the east line of said Northeast Quarter of the Northwest Quarter for 92.01 feet to the southerly line of Olmsted County Highway Right of Way Plat No. 203; thence South 89 degrees 46 minutes 40 seconds West along said southerly line for 185.14 feet to the point of beginning of the parcel to be described; thence continuing South 89 degrees 46 minutes 40 seconds West along said southerly line for 1128.86 feet to the west line of said Northeast Quarter of the Northwest Quarter; thence South 00 degrees 30 minutes 16 seconds East along said west line for 385.00 feet; thence North 89 degrees 46 minutes 40 seconds East for 1133.99 feet; thence North 01 degree 16 minutes 05 seconds West for 385.06 feet to the point of beginning and there terminating. Section 2. EFFECTIVE DATE.
