HomeMy WebLinkAboutResolution No. 260-24 - Resolution - CD2024-039PLAT Pennington Business Park 9th Subdivision RESOLUTION Approving Final Plat No. CD2024-039PLAT, To Be Known As DevCo Development, A Project Consisting Of 1 Residential Lot On 11.58 Acres, Located 350 Feet Northeast Of The Intersection Of East Frontage Rd NW and 23rd Ave NW. WHEREAS, DevCo Preservation LLC has requested from the City of Rochester Final Plat approval to be known as DevCo Development; and WHEREAS, the Final Plat proposes 1 residential lot on 11.58 acres of land located 350 feet northeast of the intersection of East Frontage Rd NW and 23rd Ave NW; and WHEREAS, the Council adopts the findings as described attached to the Community Development memo dated December 9, 2024, subject to one condition, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. H) Final Plat. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, a public hearing duly noticed and held on December 9, 2024, the following plat of lands in Olmsted County, Minnesota are to be known and designated as follows: That part of Pennington Business Park Sixth Subdivision according to the plat thereof on file at the County Recorder's office, Olmsted County, Minnesota, described as follows: All of Lot 1, Block 1, except the northerly 120.00 foot thereof, all of Lot 2, Block 1; all of Lots 1, 2, 3 and 4 of Block 2; and that part of vacated Pennington Drive N.W. and 23rd Avenue N.W. described as follows: Commencing at the northwesterly corner of Lot 5, Block, 2 of said Pennington Business Park Sixth Subdivision; thence northwesterly on a Minnesota State Plane Grid Azimuth from north of 336 degrees 48 minutes 43 seconds along a northwesterly extension of the southwesterly line of said Lot 5 a distance of 33.00 feet to the point of beginning; thence continue northwesterly 336 degrees 48 minutes 43 seconds azimuth 33.00 feet; thence northeasterly 298.16 feet on a nontangential curve northwesterly having a central angle of 54 degrees 30 minutes 11 seconds, a radius of 313.44 feet and a chord azimuth of 39 degrees 33 minutes 38 seconds; thence easterly 89 degrees 50 minutes 37 seconds azimuth 67.31 feet; thence southerly 93.96 feet on a nontangential curve concave westerly having a central angle of 14 degrees 11 minutes 18 seconds, a radius of 379.44 feet and a chord azimuth of 197 degrees 12 minutes 30 seconds; thence southeasterly 119 degrees 17 minutes 29 seconds azimuth 51.58 feet; thence southwesterly 209 degrees 17 minutes 29 seconds azimuth 66.00 feet; thence northwesterly 299 degrees 17 minutes 29 seconds azimuth 51.58 feet; thence southwesterly 134.83 feet on a nontangential curve concave northwesterly having a central angle of 20 degrees 21 minutes 36 seconds, a radius of 379.44 feet and a chord azimuth of 224 degrees 27 minutes 42 seconds to the northeasterly corner of said Lot 5; thence northwesterly 336 degrees 48 minutes 43 seconds azimuth along a northwesterly extension of the northeasterly line of said Lot 5 a distance of 33.83 feet to the center line of vacated Pennington Drive N.W.; thence southwesterly 80.73 feet along said center line on a nontangential curve concave northwesterly, having a central angle of 13 degrees 21 minutes 05 seconds, a radius of 346.44 feet and a chord azimuth of 240 degrees 08 minutes 11 seconds to the point of beginning; and all of 23rd Avenue N.W. But Excepting therefrom the following described property: That part of Lot 1 of Block 1, except the north 120 feet thereof, Lots 1, 2, and 3 of Block 2, vacated Pennington Drive NW, and vacated 23rd Avenue NW, all in Pennington Business Park Sixth Subdivision, according to the plat thereof on file at the County Recorder's office, Olmsted County, Minnesota and that part of the Northeast Quarter of the Southeast Quarter of Section 16, Township 107 North, Range 14 West, Olmsted County, Minnesota, all lying within the following described parcel of land: Commencing at the northwesterly corner of Lot 5 of said Block 2; thence northwesterly on a Minnesota State Plane Grid Azimuth from north of 336 degrees 48 minutes 43 seconds along the northwesterly extension of the southwesterly line of said Lot 5 a distance of 33.00 feet to the point of beginning; thence northeasterly 80.73 feet on a nontangential curve concave northwesterly having a radius of 346.44 feet, a central angle of 13 degrees 21 minutes 05 seconds and a chord azimuth of 60 degrees 08 minutes 12 seconds to the northwesterly extension of the northeasterly line of said Lot 5; thence southeasterly 156 degrees 48 minutes 43 seconds azimuth along said northeasterly line 338.03 feet; thence easterly 89 degrees 50 minutes 37 seconds azimuth 617.10 feet to the west line of Western Third Subdivision according to the plat thereof, on file at the County Recorder's office, Olmsted County, Minnesota and the east line of said Pennington Business Park Sixth Subdivision; thence northerly 359 degrees 39 minutes 30 seconds azimuth along said west and east lines and along the west line of Cimarron Six according to the plat thereof on file at the County Recorder's office, Olmsted County, Minnesota 522.34 feet to the south line of Cimarron Fifteenth, according to the plat thereof on file at the County Recorder's office, Olmsted County, Minnesota; thence westerly 269 degrees 50 minutes 37 seconds azimuth along the south line at said Cimarron Fifteenth and along the south line of Cimarron Sixteenth, according to the plat thereof on file at the County Recorder's office, Olmsted County, Minnesota 660.07 feet; thence southerly 179 degrees 50 minutes 37 seconds azimuth 148.33 feet; thence southwesterly 246 degrees 48 minutes 43 seconds azimuth 185.22 feet to the southeasterly corner of Lot 1, Block 3 of said Pennington Business Park Sixth Subdivision; thence southeasterly 156 degrees 48 minutes 43 seconds azimuth along the northwesterly extension of the southwesterly line of said Lot 5 a distance of 33.00 feet to the point of beginning. Also excepting the plat of Pennington Business Park Seventh. All of Lot 1 Block 1, Pennington Business Park 9th Subdivision, according to the recorded plat thereof on file at the office of the County Recorder, Olmsted County, Minnesota. Containing 11.58 acres, more or less. TO BE KNOWN as “Pennington Business Park 9th Subdivision”, DevCo Preservation LLC, Applicant, is hereby approved, and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the following conditions: 1. Prior to the recordation of the Final Plat, RPU Electric easements shall be dedicated as detailed in the comment dated November 15, 2024.
