HomeMy WebLinkAboutResolution No. 016-25 - Resolution -Final Plat CD2024-042PLAT Heim Addition RESOLUTION Approving Major Land Subdivision No. CD2024-042PLAT, To Be Known As Heim Addition, A Project Consisting Of 11 Residential Lots And Two Outlots On 8.54 th Acres, Located East Of US Highway 52 SW And South Of 25 St SW. WHEREAS, Tedman and Lori Heim have requested from the City of Rochester approval of a Major Land Subdivision to be known as Heim Addition. WHEREAS, the Major Land Subdivision proposes 11 residential lots and two outlots on 8.54 acres of land located east of US Highway 52 SW and south of 25th St SW. WHEREAS, the Council adopts the Planning Commission findings as described in the attached Community Development memo dated December 11, 2024, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit. WHEREAS, on December 11, 2024, the City of Rochester Planning Commission reviewed the application and recommended approval subject to seven conditions. WHEREAS, on January 6, 2025, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application subject to seven conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated seven conditions of approval. BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No. CD2024-042PLAT requested by Tedman and Lori Heim, subject to the conditions of approval shown below. CONDITIONS 1. Prior to Final Plat submittal, the applicant shall provide an updated Major Land Subdivision exhibit addressing additional required public utility easements as directed by Rochester Public Utilities. 2. Prior to Final Plat submittal, RPU Water comments shall be addressed. 3. Prior to Final Plat submittal, Rochester Fire Department comments shall be addressed. 4. Prior to Final Plat submittal, Civil and Stormwater Management Plans shall be approved and executed by both Public Works and Rochester Public Utilities. 5. Prior to Final Plat submittal, the applicant shall address all comments provided by RPU Water to the satisfaction of RPU. 6. Prior to the Recordation of the Final Plat, the execution of a City-prepared Development Agreement is needed to address items such as; extension of public infrastructure, ownership and maintenance of the proposed storm water facilities, remaining development related charges applicable to the Property, etc. 7. Prior to Recordation of the Final Plat, Parkland Dedication, with cash in lieu of property dedication, shall be provided to the Rochester Parks and Recreation Department. Prior to Final Plat submittal, a Floodplain Development Permit must be approved by Rochester Community Development.
