HomeMy WebLinkAboutResolution No. 028-25 - Resolution - Sale of Excess Accredited Generation Capacity RESOLUTION Authorizing the Sale of Excess Accredited Generation Capacity. WHEREAS, the City of Rochester’s Home Rule Charter under Section 15.07 Subd. 2(B) dictates that the Rochester Public Utility (RPU) Board, with authorization by resolution of the Common Council, may enter into a contract if the contract Involves the sale or purchase of real or personal property in an amount greater than $100,000; and WHEREAS, the RPU Board has approved a sales agreement with another utility provider, known as a bilateral sale, of Excess Accredited Generation Capacity for the amount of $1,101,600, over the term of June 1, 2025 – May 31, 2027; and WHEREAS, this sale is not occurring through existing contracts and was not considered in the 2025 Budget, necessitating Common Council approval in accordance with the City’s Charter as previously referenced; and WHEREAS, without this agreement, the excess capacity will then follow the approved contracts and/or be sold at the market capacity auction, likely resulting in getting a much lower price for the excess capacity. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester, Minnesota, that the sales agreement for sale of Excess Accredited Generation Capacity as referenced in this action is hereby approved.
