RESOLUTION
Approving Annexation Application No. CD2025-001ANX, to Annex Approximately 330
Acres, Generally Situated East Of CSAH 158, West Of 60th Ave. NW, South of 55th St. NW
and North Of Behrens Ln. NW. in Section 13, Township 107 North, Range 15 West, In
Accordance With The Second Amendment of Joint Resolution for Orderly Annexation for
Kalmar Township, Approved February 21, 2017.
WHEREAS, a joint resolution for orderly annexation was originally adopted by the City of
Rochester and Kalmar Township, known as Joint Resolution for Orderly Annexation for Kalmar
Township; on September 3, 2003, and,
WHEREAS, the boundaries for the Joint Resolution for Orderly Annexation between the City and
Kalmar Township were updated in 2016 and most recently in February of 2017; and
WHEREAS, the property owner has requested that the City of Rochester initiate an annexation
of the subject site via Orderly Annexation Resolution on March 17, 2025; pursuant to M.S.
414.0325; and,
WHEREAS, the subject resolution provides a legal description encompassing the approximate
330 acre site, and
WHEREAS, the Joint Resolution for Orderly Annexation Agreement between the City of
Rochester establishes that Lands ordered annexed pursuant to the Agreement will not be
subject to any differential taxation as referenced in Minnesota Statutes 414.035 and Property
taxes payable on annexed land shall continue to be paid to the Township for the entire year in
which the annexation becomes effective.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the
area of land located within Section 13, Township 107 North, Range 15 West, Olmsted County,
Minnesota, be annexed into the City of Rochester Incorporated Limits in accordance with Joint
Resolution for Orderly Annexation between the City of Rochester and Kalmar Township, more
particularly described herein by the following legal description:
Annexation of Land Legal Description:
All of the Northeast Quarter of Section 13, and all of the East One-Half of the Northwest
Quarter of Section 13, Township 107 North, Range 15 West, Olmsted County, Minnesota.
EXCEPT the North 60 feet thereof and EXCEPTING the North 1900.00 feet of the East
1300.00 feet of the Northeast Quarter of said Section 13.
AND
That part of the West One-Half of the Southeast Quarter of Section 13, Township 107
North, Range 15 West, Olmsted County, Minnesota, described as follows:
Commencing at the Southwest corner of the Southeast Quarter of Section 13; thence
North 00 degrees 02 minutes 04 seconds East, assumed bearing, 1449.02 feet for a point
of beginning; thence continue North 00 degrees 02 minutes 04 seconds East. 511.13 feet
to the Southwest corner of the North 40.00 acres of the Southeast Quarter of said Section
13; thence North 89 degrees 55 minutes 47 seconds East, along the South line of said
North 40.00 acres, 1004.86 feet; thence South 00 degrees 02 minutes 04 seconds West
parallel with the West line of Southeast Quarter, 1120.62 feet to the center line of County
Road No. 4 (as described in Book y-3 of Miscellaneous Records, Page 283, Olmsted
County, Recorder’s Office); thence North 72 Degrees 44 minutes 53 seconds West, along
said center line 417.87 feet, thence Northwesterly 336.01 feet, along said center line, along
a curve, concave to the Northeast, central angle of 00 degrees 30 minutes 14 seconds,
radius of 38197.19 feet and a chord of said curve bears North 72 degrees 29 minutes 46
seconds West, 336.01 feet to a point being 285.20 feet east of, as measured at right angles
to the West line of said Southeast Quarter, thence North 00 degrees 02 minutes 04
seconds East parallel with said West line, 383.09 feet; thence North 89 degrees 57
minutes 56 seconds West, 285.20 feet to the point of beginning.
AND
That part of the Southeast Quarter of Section 13, Township 107 North, Range 15 West,
Olmsted, Minnesota, described as follows:
Commencing at the Southwest corner of the Southeast Quarter of said Section 13; thence
North 00 degrees 02 minutes 04 seconds East, assumed bearing, 1950.15 feet to the
Southwest corner of the North 40.00 acres of the Southeast Quarter of said Section 13;
thence North 89 degrees 55 minute 47 seconds East, 1004.88 feet for a point of beginning;
thence South 00 degrees 02 minutes 04 seconds West, parallel with the West line of
Southeast Quarter, 1120.62 feet to the center line of County Road No. 4 (as described in
Book Y-3 of Miscellaneous Records, page 283, Olmsted County Recorder’s Office);
thence South 72 degrees 44 minutes 53 seconds East, along said center line, 845.51 feet,
thence continue Southeasterly 935.12 feet, along said center line, along a curve, concave
to the Southwest, central angle 46 degrees 45 minutes 20 seconds radius of 1145.92 feet
and chord of said curve bears South 49 degrees 22 minutes 13 seconds East 909.39 feet
to the South line of said Southeast Quarter; thence South 89 degrees 57 minutes 02
seconds East along said South line, 141.90 feet to the Southeast corner of said Southeast
Quarter, thence North 00 degrees 02 minutes 35 seconds West, along the east line of said
Southeast Quarter, 1965.67 feet to the Southeast corner of the North 40.00 acres of said
Southeast Quarter; thence South 89 degrees 55 minutes 47 seconds West parallel with
the North line of said Southeast Quarter 1637.39 feet to the point of beginning.
AND
That part of the Est One-Half of the Southwest Quarter of Section 13, Township 107 North,
Range 15 West, Olmsted County, Minnesota, described as follows:
Commencing at the Southeast corner of the Southwest Quarter of Said Section 13;thence
North 00 degrees 02 minutes 04 seconds East, assumed bearing, along the East line of

said Southwest Quarter, 1158.30 feet to the center line tangent of County Road No. 4 (as
described in Book C-4 of Miscellaneous Records, Page 402, Olmsted County Recorder’s
Office) for a point of beginning; thence North 71 degrees 47 minutes 23 seconds West,
along said center line tangent, 1376.11 feet to the West line of the East One-Half of said
Southwest Quarter; thence North 00 degrees 05 minutes 53 seconds West, along said
West line, 1029.76 feet to the Northwest corner of the East One-Half of said Southwest
Quarter; thence North 89 degrees 55 minutes 47 seconds East, along the North line of
said Southwest Quarter, 1309.82 feet to the Northeast corner of said Southwest Quarter;
thence South 00 degrees 02 minutes 0 seconds West, along the East line of said
Southwest Quarter, 1461.40 feet to the point of beginning.
AND
The North 40.00 acres of the Southeast Quarter of Section 13, Township 107 North,
Range 15 West, Olmsted County, Minnesota.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained in the office
of the Community Development Department of the City of Rochester and shall be available for
public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified copy of this
resolution in the office of the County Recorder in and for Olmsted County, Minnesota.
