HomeMy WebLinkAboutResolution No. 087-25 - Resolution - Agreement- Minnesota Wetland Conservation Act RESOLUTION Accepting the City’s Authority and Administrative Responsibility to Implement the Wetland Conservation Act and Delegating Certain Function of the Wetland Conservation Act to a Qualified Representative From Olmsted County. WHEREAS, the Wetland Conservation Act (WCA) of 1991 was enacted to preserve and protect Minnesota’s wetlands and requires local implementation by a designated Local Government Unit (LGU); and WHEREAS, the City of Rochester has previously accepted the authority and administrative responsibility to implement the WCA within the legal boundaries of the City in accordance with Minnesota Rules, Chapter 8420; and WHEREAS, the City is authorized by Minnesota Administrative Rules Part 8420.0200, Subpart 2, Item C, to delegate certain functions with regard to implementation of the WCA, including the authority to make decisions on applications, with its staff; and WHEREAS, Olmsted County has qualified personnel trained in application of the WCA. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester, that the City of Rochester reaffirms its Authority and Administrative Responsibility to Implement the WCA. BE IT FURTHER RESOLVED that decision-making authority for WCA exemption, no-loss, wetland boundary and type, sequencing, replacement plan, wetland banking, and other required applications are placed with a qualified representative from Olmsted County.
