HomeMy WebLinkAboutResolution No. 088-25 - Resolution - Reinstating the Joint Airport Zoning Board RESOLUTION Reestablishing the Rochester International Joint Airport Zoning Board and an invitation to the surrounding counties to participate. WHEREAS, the City of Rochester owns an international airport which is located in portions of Sections 4, 9, 10, 15, 16, and soon Section 21 of Township 105 North, Range 14 West, Olmsted County, Minnesota; and, WHEREAS, in order to promote the health, safety, order, convenience, prosperity, and general welfare and to conserve property values and encourage the most appropriate use of land, the City of Rochester has chosen to regulate in airport hazard areas: (1) land use; (2) height restrictions; (3) the location, size, and use of buildings; and (4) the density of population; and, WHEREAS, portions of the airport hazard areas appertaining to the Rochester International Airport are located within the territorial limits of another county; and, WHEREAS, the original joint airport zoning board as it relates to the current location of the Rochester International Airport was created by Ordinance No. 973 on or about October 7, 1957. Various amendments to the ordinance have been made and council resolutions have reestablished the joint airport zoning board at several points in the past; and, WHEREAS, historical records indicate that the joint airport zoning board last met over a decade ago and all board member’s terms have since expired; and, WHEREAS, the City of Rochester, as the owning authority of the Rochester International Airport, now wishes to reestablish the Joint Airport Zoning Board. Pursuant to Minn. Stat. §360.063, subd. 3 (2024) the City of Rochester has the authority to request that a county in which an airport hazard area is located to join in reestablishing the Joint Airport Zoning Board; and, WHEREAS, said Joint Airport Zoning Board shall have the power to adopt, administer, and enforce airport-zoning regulations applicable to the airport hazard area in question; and, WHEREAS, Minn. Stat. §360.063, subd. 3 (2024) establishes a procedure in which the Common Council of the City of Rochester may by resolution invite participation in the reestablishment of a Joint Airport Zoning Board. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester: (1) That pursuant to Minn. Stat. §360.063, subd. 3 (2024), the City of Rochester hereby requests the counties of Olmsted, Fillmore, Mower, and Dodge join the City of Rochester in the reestablishment of a Joint Airport Zoning Board by each appointing two (2) members. (2) That the City of Rochester, being a municipality of the first class, shall appoint four (4) members to the board, and the chair of said board shall be one of the City’s four appointed members as elected by the membership of the board. (3) That the counties mentioned above in paragraph (1) are given notice that if they wish to participate in the reestablishment of said Joint Airport Zoning Board with the City of Rochester, that Minn. Stat. §360.063, subd. 3 (2024) requires said participating county to give notice to the City of Rochester of their intent to do so within sixty (60) days of receipt of this request, and to identify the two (2) representatives each county will appoint to said reestablished Joint Airport Zoning Board. (4) The City Clerk is authorized and directed to send, by certified mail, a copy of this resolution and request to the governing bodies of each of the counties named in paragraph (1).
