RESOLUTION
Approving Major Land Subdivision No. CD2025-003PLAT, To Be Known As London
Brook Ponds, A Project Consisting Of 50 Residential, 1 Multifamily Lot, 1 Day Care
Facility Lot and 1 Lot for Common Area, On 6.25 Acres, Located 250 Feet South Of
8 ½ St. SE and East of 16th Ave. SE.
WHEREAS, Build Wealth MN Inc., requested from the City of Rochester approval of a
Major Land Subdivision to be known as London Brook Ponds,
WHEREAS, the Major Land Subdivision proposes 50 Residential, 1 Multifamily Lot, 1 Day
Care Facility Lot and 1 Lot for Common Area, On 6.25 Acres, Located 250 Feet South Of
8 ½ St. SE and East of 16th Ave. SE.
WHEREAS, the Council adopts the Planning Commission findings as described in the
attached Community Development memo dated April 9, 2025, and finds the proposal
meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit.
WHEREAS, on April 9, 2025, the City of Rochester Planning Commission reviewed the
application and recommended approval subject to two conditions.
WHEREAS, on May 5, 2025, the City of Rochester Common Council held a public hearing
to consider this application and adopted the findings of fact and approved the application
subject to two conditions.
NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester
that, based upon the above-stated findings of fact, the Applicant has shown by a
preponderance of the evidence submitted at the public hearing that it has satisfied the above
criteria subject to the imposition of the below-stated two conditions of approval.
BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No.
CD2025-003PLAT, requested by Build Wealth MN Inc., subject to the conditions of
approval shown below:
CONDITIONS
1. Prior to Final Plat submission, Civil Plans & Stormwater Management Plan
approval by Rochester Public Utilities and Rochester Public Works is required.
2. Prior to Final Plat submission, a Property Owner Executed, City-prepared
Development Agreement is required to address the adequacy of public facilities
and to memorialize terms and obligations related to items such as; extension of
public infrastructure, ownership and maintenance of the proposed storm water
facilities and remaining development related charges applicable to the property.
