RESOLUTION
Awarding Contract for Project Sanitary Sewer Improvements Institute Rd SW from
MH 87/0783 to Crest Ln SW.
WHEREAS, pursuant to an advertisement for bids for the following improvement(s): Project
No. Sanitary Sewer Improvements Institute Rd SW from MH 87/0783 to Crest Ln SW,
the following bids were received complying with the advertisement:
Kats Excavating, LLC. $78,390.02
DeCook Companies $94,664.50; and
WHEREAS, it appears that Kats Excavating, LLC.. is the lowest responsive and
responsible bidder.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that the bid of $78,390.02, is hereby accepted and execution of the standard City
contract for construction with Kats Excavating, LLC., is authorized for the following
approved local improvements: Project No. Sanitary Sewer Improvements Institute Rd
SW from MH 87/0783 to Crest Ln SW; and
BE IT FURTHER RESOLVED that the City Clerk is directed to return to all bidders the
deposits made with their bids, except the deposits of the successful bidder and the next
lowest bidder, which shall be retained until the contract has been executed; and
BE IT FURTHER RESOLVED that the bidder shall execute all contracts within ten days
after the contract is ready for their signature, and if not executed by them in said time, they
shall be deemed to have abandoned the same.
